Winnebago County Small Claims Court: Defendant Guide to the 17th Judicial Circuit
The 17th Judicial Circuit in Rockford
Winnebago County small claims cases are heard in the 17th Judicial Circuit, headquartered at the Winnebago County Courthouse in Rockford. The same statewide rules that govern small claims across all 102 Illinois counties — Supreme Court Rules 281 through 289 — apply here, with local administrative orders filling in the procedural details.
The $10,000 jurisdictional cap under Rule 281 applies. If you've been served with a claim at or under that threshold, you're in the right place.
Filing a Response in Winnebago County
Under Rule 286(a), you are not required to file a written answer unless the judge orders one. Appearing on the return date — in person or remotely, depending on the current court order — operates as an automatic denial of the complaint.
What you must do:
- File an Appearance form with the Winnebago County Circuit Clerk. Defendants do not pay an appearance fee in Illinois small-claims cases.
- Show up on the return date. The summons specifies this date. If a properly served defendant misses it, the court may enter a default judgment for the amount the plaintiff proves.
- File through eFileIL. Electronic filing is mandatory in all Illinois circuit courts. If you lack computer access or internet, you can claim an exemption using Form EWC 3401 and file in person at the clerk's office.
Defendants do not pay an appearance fee. A fee waiver may be available for other fee-bearing filings: full waivers are available at or below 125% of the federal poverty guidelines, with partial waivers up to 200% FPL.
What to Expect on the Return Date
The return date is not a trial. It's an administrative appearance where the judge confirms both sides are present and learns whether the case will settle, go to mediation, or proceed to a hearing.
In the 17th Circuit, check the current local administrative order for whether initial appearances are conducted by Zoom or in person. This changes — circuits have shifted between remote and in-person formats multiple times since 2020. The clerk's office or the court's website confirms the current format.
If attending remotely, join the waiting room early, set your Zoom display name to match your legal name exactly as it appears in the case caption, stay muted until called, and never record the proceeding. Recording a court session violates Supreme Court Rule 45 and is punishable as contempt.

Mediation Before Trial
Winnebago County, like most Illinois circuits, offers court-annexed mediation. If both parties agree to mediate and reach a settlement, the mediator drafts an Agreed Settlement Order. Defendants do not pay an appearance fee in Illinois small-claims cases, effective October 1, 2025.
Mediation is confidential. Nothing you say during the session is admissible if the case goes to trial.
Preparing for a Hearing
If the case doesn't settle, it moves to a bench trial under Rule 286(b). The judge can relax formal evidence rules, which means you can present text messages, photos, receipts, and emails without strict foundation requirements — but you still need to organize them.
Prepare three copies of every exhibit: one for the judge, one for the opposing party, one for yourself. Label each document clearly and arrange them in chronological order.
Witnesses must testify live under oath. Written statements from absent witnesses are generally excluded as hearsay, even under the relaxed standard. If a witness won't come voluntarily, issue a subpoena under Rule 237 with the required $20/day fee and $0.20/mile mileage tender.
After the Hearing
The judge's oral statements from the bench aren't enforceable until a written judgment order is signed and entered on the clerk's docket. Once that happens, if you disagree with the outcome, you have 30 days to file a Motion to Reconsider under 735 ILCS 5/2-1203, or 30 days to file a Notice of Appeal under Supreme Court Rules 301–303. The appeal goes to the Fourth District Appellate Court, which covers Winnebago County.
If you missed the return date and a default judgment was entered, you have 30 days from its entry to file a Motion to Vacate under 735 ILCS 5/2-1301(e), which uses a liberal "substantial justice" standard and doesn't require you to prove a full meritorious defense.
The Illinois Small Claims Response Guide covers every step from verifying your summons through post-decision options, with worksheets for evidence organization and deadline tracking.
