Small Claims Start Guide — Plain-Language Guides to Small Claims Courts and Civil Tribunals

Independent step-by-step guides to filing a small claim, responding to one and collecting the money, for US small claims courts, the UK County Court and Sheriff Court, Australian tribunals such as NCAT, VCAT and QCAT, Canadian small claims courts and New Zealand's Disputes Tribunal.

Small claims court is built for people without lawyers, yet nobody hands you the order of operations. Before the hearing there is a demand letter that may be required, a limit your claim has to fit, a time limit that may already be running, a form with its own fee, and papers that have to be served on the other side in exactly the way the court accepts. Miss a step and the case is dismissed, delayed, or never gets heard.

Every court and tribunal runs that sequence differently. A California claim, an Ontario claim, a VCAT application in Victoria and a Disputes Tribunal claim in New Zealand have different limits, forms, fees, deadlines and hearing rules, and the official pages describe each step on its own. Each of our guides takes one jurisdiction and one job (filing a claim, responding to one, or collecting the money after you win) and walks through it in the order you will meet it, with checklists and the questions to ask the court office.

If you have just been served, the clock is already running: most courts give days, not months, to respond, and a missed deadline can mean a judgment against you without a hearing. Our response guides explain what the papers mean and what each option involves. Every guide is independent and is not affiliated with any court or tribunal. We explain procedure; we do not give legal advice or predict outcomes, and each guide points to the free help that exists, from court self-help centres to legal aid and community legal centres.
