Sangamon County Small Claims Court: Defendant Guide to the 7th Judicial Circuit
The 7th Judicial Circuit in Springfield
Sangamon County operates under the 7th Judicial Circuit, with small claims cases heard at the Sangamon County Courthouse in Springfield — the state capital. The court handles claims up to $10,000 under Illinois Supreme Court Rules 281–289, the same statewide rules that apply in every Illinois county.
Being in the capital doesn't mean special rules apply. Sangamon County follows the same procedural framework as Cook County or any rural circuit. The differences are in local administrative orders — hearing formats, fee amounts, and courthouse logistics.
How to Respond
When served with a small claims summons in Sangamon County:
Verify the case with the Sangamon County Circuit Clerk. Check the online docket portal or call the office to confirm the case number and return date. If the case doesn't appear in the system, it may still be in processing — call rather than assume it's a scam.
File an Appearance through eFileIL. Electronic filing is mandatory. If you lack internet access, complete Form EWC 3401 to claim an exemption and file in person. Defendants do not pay an appearance fee in Illinois small-claims cases.
Appear on the return date. Under Rule 286(a), you don't need a written answer unless the judge specifically orders one. Showing up operates as a denial of the complaint.
Apply for a fee waiver if you file another fee-bearing paper, such as a counterclaim. Eligibility: 125% FPL for a full waiver, up to 200% FPL for partial relief. The court rules within 30 days; an e-filed paper submitted with the application is conditionally accepted while the application is pending.
If a properly served defendant misses the return date, the court may enter a default judgment for the amount the plaintiff proves. If a default judgment is entered, you have 30 days from its entry to file a Motion to Vacate under 735 ILCS 5/2-1301(e), arguing "substantial justice" — the standard is liberal and doesn't require proving a complete meritorious defense.
Fees
Sangamon County sets fees under the Clerks of Courts Act, with caps updated by Public Act 104-468 (effective July 1, 2026). The defendant appearance fee is $0 statewide. Call the clerk's office for fees on a counterclaim or other fee-bearing filing. Counterclaim fees are the new-case filing fee for that claim amount.
Witness subpoenas require tendering $20/day plus $0.20/mile — without this, the subpoena is legally unenforceable.

What Happens at Court
The return date is administrative, not a trial. The judge confirms both parties are present, asks whether there's a chance of settlement, and either refers the case to mediation or schedules a hearing.
For the actual hearing, Rule 286(b) applies. The judge can relax formal evidence rules, meaning you can present text messages, photos, and receipts without strict foundation testimony. But organization matters — bring three copies of every exhibit (judge, opposing party, yourself), labeled and in order.
All witness testimony is live and under oath. Written statements from absent witnesses are generally excluded as hearsay, even under relaxed rules. If someone won't come voluntarily, subpoena them under Rule 237.
After the Decision
Appeals from Sangamon County go to the Fourth District Appellate Court in Springfield. The 30-day appeal deadline under Supreme Court Rules 301–303 is strict and jurisdictional.
If no court reporter was present at the hearing — which is typical in small claims — you'll need to prepare a bystander's report or agreed statement of facts for the appellate record.
A timely post-trial motion under 735 ILCS 5/2-1203 (Motion to Reconsider) tolls the appeal clock — the 30-day window starts again when the court enters the order disposing of the motion.
The Illinois Small Claims Response Guide covers the full defendant process from summons verification through appeals, with worksheets for evidence organization and deadline tracking.
