Peoria County Small Claims Court: Filing, Fees, and Defendant Procedures
The 10th Judicial Circuit
Peoria County small claims cases are heard in the 10th Judicial Circuit at the Peoria County Courthouse on Main Street. The circuit also covers Stark, Marshall, Putnam, and Tazewell counties, so the same local administrative orders may apply across several courthouses in the region.
All small claims in Peoria County follow Illinois Supreme Court Rules 281–289. The maximum claim amount is $10,000, and defendants have the right to appear pro se under Rule 282.
Responding to a Claim
If you've been served, here's what to do:
Verify the case. Check the Peoria County Circuit Clerk's online portal or call the clerk's office to confirm the case number, assigned courtroom, and return date. Fraudulent payment demands sometimes mimic court papers, but an online docket may not show a newly served case right away; if it does not appear, call the clerk to verify.
File an Appearance. Submit the statewide standardized Appearance form through eFileIL. Defendants do not pay an appearance fee in Illinois small-claims cases.
Show up on the return date. Under Rule 286(a), you don't need to file a written answer unless the judge orders one. Your appearance operates as a denial of the complaint, and you can raise any defense at trial as if it were specifically pleaded.
If a properly served defendant misses the return date, the court may enter a default judgment for the amount the plaintiff proves. If a default judgment has already been entered, you have 30 days from its entry to file a Motion to Vacate under 735 ILCS 5/2-1301(e).
Fees
Peoria County sets its fees under the Clerks of Courts Act (705 ILCS 105/27.1b), amended by Public Act 104-468 effective July 1, 2026. The county's September 4, 2026 schedule lists small-claims filing fees of $119 for claims up to $2,500 and $281 for claims from $2,500.01 to $10,000. Defendants do not pay an appearance fee in small-claims cases.
Counterclaim filing fees are the new-case filing fee for that claim amount. Verify the current schedule directly with the clerk before filing.
If you plan to subpoena witnesses, budget $20 per day per witness plus $0.20 per mile — a subpoena without this fee tender is unenforceable under 705 ILCS 35/4.3.

Hearing Format
Check with the 10th Circuit clerk's office for whether your initial appearance is by Zoom or in person. Downstate circuits vary — some hold remote first appearances and require in-person trials, while others conduct everything at the courthouse.
If attending remotely, set your display name to match the case caption exactly, stay muted until called, and don't record. Recording violates Supreme Court Rule 45.
Contested cases proceed to a bench trial under Rule 286(b). The judge can relax formal evidence rules, but you still need organized exhibits — three copies of everything (judge, opposing party, yourself), labeled and in chronological order. Witness testimony must be live and under oath; written statements from absent witnesses are typically excluded as hearsay.
Appeals from Peoria County
Appeals go to the Fourth District Appellate Court in Springfield. File a Notice of Appeal within 30 days from entry of the judgment, or within 30 days from entry of the order disposing of a timely post-trial motion under 735 ILCS 5/2-1203. This deadline is jurisdictional — late filings are dismissed.
Because court reporters are rarely present at small claims hearings, you'll likely need to prepare a bystander's report of proceedings approved by the trial judge, or an agreed statement of facts signed by both parties, to give the appellate court a record to review.
The Illinois Small Claims Response Guide covers every step of the defendant process, from reading your summons through post-decision motions and appeals.
