St. Clair County Small Claims Court Illinois: Defendant Guide to the 20th Judicial Circuit

The 20th Judicial Circuit in Belleville

St. Clair County operates under the 20th Judicial Circuit, with small claims cases heard at the St. Clair County Courthouse in Belleville. Along with neighboring Madison County, it covers the Metro East region on the Illinois side of the St. Louis metropolitan area.

Small claims in St. Clair County follow the same statewide rules — Illinois Supreme Court Rules 281–289 — as every other county. Claims are capped at $10,000 under Rule 281, and defendants have the right to self-represent under Rule 282.

Responding to a Claim

If you've been served with a small claims summons:

  1. Verify the case with the St. Clair County Circuit Clerk's office. Confirm the case number, return date, and courtroom assignment through the online portal or by calling the clerk.

  2. File an Appearance through eFileIL. Electronic filing is mandatory statewide. Defendants do not pay an appearance fee in Illinois small-claims cases. A fee waiver may be available for other fee-bearing filings (full waiver at or below 125% FPL, partial waivers up to 200% FPL).

  3. Show up on the return date. Under Rule 286(a), you don't need to file a written answer unless the judge specifically orders one. Appearing on the return date operates as a denial of the complaint.

If a properly served defendant misses the return date, the court may enter a default judgment for the amount the plaintiff proves. If a default judgment has already been entered, you have 30 days from its entry to file a Motion to Vacate under 735 ILCS 5/2-1301(e). The court applies a "substantial justice" standard — you don't need to prove a complete meritorious defense, though showing why you missed the date helps.

Fees

St. Clair County sets its fee schedule under the Clerks of Courts Act (705 ILCS 105/27.1b), with caps updated by Public Act 104-468 effective July 1, 2026. Defendants do not pay an appearance fee in Illinois small-claims cases. Call the clerk's office to verify fees for a counterclaim or another fee-bearing filing.

Counterclaim fees equal the new-case filing fee for the counterclaim amount. Note that if you're a corporation or LLC, filing a counterclaim requires you to retain a licensed attorney under Rule 282(b) — the self-representation exception only covers defending, not pursuing affirmative claims.

Court Procedures

Check with the 20th Circuit clerk's office for whether initial appearances are conducted by Zoom or in person. The format varies by administrative order and can change.

For contested hearings, Rule 286(b) applies. The judge can relax formal evidence rules, but organized evidence still matters. Bring three copies of every exhibit (judge, opposing party, yourself). Common exhibits include contracts, invoices, photos, text message screenshots, and bank statements.

Witnesses must testify live under oath. Written statements from absent witnesses are generally excluded as hearsay. Subpoena reluctant witnesses under Rule 237, with the mandatory fee tender of $20/day plus $0.20/mile.

After the Decision

Appeals from St. Clair County go to the Fifth District Appellate Court — the same district that handles Madison County appeals. File a Notice of Appeal within 30 days of the final judgment under Supreme Court Rules 301–303. This deadline is jurisdictional and cannot be extended.

Since court reporters rarely attend small claims hearings, prepare a bystander's report of proceedings or an agreed statement of facts for the appellate record. Without a record, the appellate court has nothing to review.
