Yukon Small Claims Court Forms: Complete List and How to Use Them
Where to Get the Forms
All prescribed Small Claims Court forms are available as downloadable fillable PDFs from the Yukon Courts website under the Small Claims Forms section. Contact a registry if you need a paper copy.
There is no online filing system. You download the form, fill it out, and submit it at the registry counter, by mail, or by fax. Fax filings must be followed immediately by mailing the original signed documents.
The Forms You Will Actually Use
The regulations prescribe 30 forms, but most claimants only need a handful. Here are the ones that matter at each stage of a typical claim.
Starting Your Claim
Form 01 — Claim. The document that launches everything. It asks for:
- Court name and filing registry (Whitehorse, Dawson City, or Watson Lake)
- Full legal names and addresses for all claimants and defendants
- The claim amount (up to $25,000)
- Interest rate (contractual or statutory)
- A concise statement of facts explaining what happened and what is owed
Attach supporting documents — the contract, invoices, demand letter, photos — on supplementary pages. Label each attachment.
Form 06 — Notice to Alleged Partner. Required if you are suing a partnership. Serve this alongside Form 01 to establish personal liability for each named partner.
Proving Service
Form 07 — Affidavit of Service. After serving the defendant, you swear this affidavit confirming how, when, and where service happened. File it with the registry as proof of service; it is required for a default judgment application.
If the Defendant Does Not Reply
Form 10 — Requisition for Order. Use this with Form 07 and Form 13 or Form 14 to request a default judgment after the defendant's reply period expires (20 calendar days in Yukon; 30 calendar days outside Yukon).
Form 13 — Default Judgment. For fixed-amount debts where the sum is clear (e.g., an unpaid invoice for exactly $4,200).
Form 14 — Default Judgment (Amount to be Assessed). For claims where the exact damages need a judge to calculate (e.g., repair costs that require evidence).
Before and During Trial
Form 15 — Notice of Trial. Filed to set the case down for a hearing. Costs $50.
Form 17 — Summons to Witness. Compels a witness to attend trial. You must serve this in person with conduct money (a small amount for their travel).
After Judgment
Form 19 — Writ of Seizure and Sale. Directs the Sheriff to seize and sell the debtor's personal property or land to satisfy the judgment.
Form 21 — Notice of Examination. Summons the debtor to a financial examination where they must disclose income, assets, and bank accounts under oath.
Common Mistakes That Get Forms Rejected
Registry clerks reject defective filings — and a rejected form does not stop the limitation clock. The most common errors:
- Wrong defendant name. Using a trade name instead of the registered corporate name. Search YCOR (Yukon Corporate Online Registry) before you fill in Form 01.
- Missing signature. Every form with a signature line must be signed. Unsigned forms are returned.
- Incomplete party details. Leaving out the defendant's address or phone number when you know it.
- Unpaid fees or missing originals. If you file by fax, mail the original signed documents immediately and make sure the filing fee reaches the registry within one week; otherwise, the document is rejected.
