Yukon Small Claims Court Fees: Filing Costs and Fee Schedule
What It Costs to File a Small Claim in Yukon
The filing fee depends on how much you are claiming. Fees are set by the Small Claims Court Regulations and are payable when you submit your Form 01 — Claim.
| Action | Fee |
|---|---|
| Filing a claim up to $5,000 | $50 |
| Filing a claim over $5,000 to $25,000 | $100 |
| Filing a disputed Reply (defendant) | $25 |
| Filing a Notice of Trial (Form 15) | $50 |
| Record search (non-party) | $2 |
| Certified copy of a document | $5 |
| Certificate of Judgment | $5 |
Payment methods listed by the court include cash, debit card, credit card, or certified cheque.
Additional Costs to Plan For
Beyond the filing fee, factor in these expenses:
Fax filing surcharge. If you file by fax instead of in person or by mail, local filers pay a $16 administrative fee plus $1 per page. Filers outside the registry's municipality are exempt from the $16 base charge. Fax filings must not exceed 20 pages without prior registrar approval, must be followed immediately by mailing the original signed documents, and the filing fee must reach the registry within one week — otherwise the filing is rejected.
Service costs. You are responsible for delivering the claim to the defendant. Registered mail costs vary by destination and package; check Canada Post's current rates. If you hire a process server, ask for a current quote. Sheriff's fees are governed by the Supreme Court Rules of Court, Appendix C, Schedule 2.
Photocopying. Registry photocopies cost $0.50 per page. You will need copies of your claim for yourself, each defendant, and the court file.
Witness summons. If you need to compel a witness to attend trial (Form 17 — Summons to Witness), you must pay the witness's conduct money for travel and attendance.
Can You Get the Filing Fee Back?
Yes — if you win. Costs awarded are generally limited to court filing fees, service expenses, witness conduct money, and fixed statutory allowances. Include a request for costs on your Form 01.
If you lose, you are not getting the filing fee back, and the judge could order you to pay part of the defendant's costs.

Is There a Fee Waiver?
Yukon Small Claims Court has no automatic fee waiver mechanism. Registry clerks collect the prescribed fee at filing unless a judicial order waiving it has been obtained.
Example Court Charges
For a $3,000 unpaid-invoice claim filed in person at Whitehorse:
- Filing fee: $50
- Plus the current costs of service and copies
For a $15,000 contractor-dispute claim:
- Filing fee: $100
- Notice of Trial: $50 if you file one
- Plus the current cost of service and copies
Compare that to hiring a lawyer at $300–$500 per hour in Whitehorse. For claims under $10,000, the economics strongly favour filing yourself.
