Yukon Small Claims Form 02 Reply: How to Fill It Out
What Form 02 Is and Where to Get It
Form 02 Reply is the official document you file to respond to a small claim in Yukon's Small Claims Court. It's a fillable PDF available from the Yukon Courts website under Rules & Forms, or you can pick up a paper copy at the court registry in Whitehorse, Dawson City, or Watson Lake.
The form is structured into four sections, each serving a different purpose. You don't need to use every section—just the ones that apply to your situation.
Section by Section Breakdown
Section 1: Your Contact Information. Fill in your full legal name, mailing address, phone number, and an address for service where you can receive future court documents. If you're a corporation, use the exact registered name (including "Inc." or "Ltd.").
Section 2: Your Statement of Defence. This is the core of your reply. You need to respond to each allegation in the plaintiff's Form 01 Claim with specific facts. A blanket denial like "I disagree with everything" won't survive a pre-trial conference.
Take the claim point by point. If the plaintiff says you owe $6,000 for work they completed on your deck, your defence might explain that the work was left unfinished, the materials were substandard, or you already paid $4,000 that isn't reflected in their claim. Back each denial with what actually happened—dates, amounts, and any written communications between you.
If you need more space than the form provides, attach additional pages and label them "Schedule A — Continuation of Statement of Defence."
Section 3: Admissions and Payment. If you agree you owe some or all of the amount claimed, record it here. You can admit the full amount and pay it (no filing fee), admit part and dispute the rest, or admit the debt but propose an instalment payment plan. For a payment plan, lay out a realistic schedule—the plaintiff can accept it or reject it and let a judge decide.
Section 4: Counterclaim and Signature. If you have your own claim against the plaintiff arising from the same dispute, indicate that here and file a separate Form 03 Counterclaim alongside your reply. Sign the form—an unsigned reply will be rejected by the registry.
Filing and Fee
Submit the completed Form 02 to any Yukon Small Claims Court registry within the applicable 20-day or 30-day response period, and serve a copy on the plaintiff within that same period. If you're disputing the claim (fully or partially), the filing fee is $25. If you're admitting the full amount and paying, there's no fee.
You can file in person during registry hours (Whitehorse: 9:00 AM–4:00 PM; Dawson City and Watson Lake: 9:00 AM–1:00 PM), by mail with the fee payable to the "Minister of Finance," or by fax—but faxed filings must be followed up immediately by mailing the signed originals.
After filing, serve a copy of the stamped Form 02 on the plaintiff by personal delivery, prepaid registered mail, or regular post, then file a Form 07 Affidavit of Service with the court to prove you did it.

Common Mistakes That Get Replies Rejected
The registry clerk will reject an incomplete filing, and the rejection doesn't stop the clock on your 20-day (or 30-day) deadline. Watch for these:
- Missing signature — the form must be signed by the defendant, an authorized corporate officer, or counsel
- Missing filing fee — $25 must accompany a disputed reply; cheques payable to "Minister of Finance"
- Generic denials — while the clerk accepts the form, a vague defence will be exposed at the pre-trial conference
- Wrong form — Ontario's Form 9A Defence or BC's Reply to Civil Claim are not valid in Yukon
