Virginia Beach Small Claims Court: How to File a Claim
Filing a Small Claims Case in Virginia Beach
The Virginia Beach General District Court handles small claims cases under the same statewide rules as every other Virginia locality — claims up to $5,000, Form DC-402, with parties generally representing themselves subject to statutory exceptions, and informal hearings. But Virginia Beach has some local administrative practices worth knowing before you file.
The courthouse is at 2425 Nimmo Parkway, Virginia Beach, VA 23456. The civil clerk's office accepts small claims filings at the counter during business hours and by mail.
Fees and Filing
Filing fees follow the standard Virginia schedule: $35–$38 for claims up to $500, $50–$57 for claims between $500.01 and $5,000, plus $12 per defendant for sheriff service. Virginia Beach typically sets return dates 30–45 calendar days from the date of filing for Warrants in Debt.
Local Court Practices
Virginia Beach General District Court has a few practices that differ from smaller Virginia courts:
Pre-trial motions must be submitted in writing. Unlike rural courts where you might raise a motion verbally on the return date, Virginia Beach requires written motions. Motions may be faxed in time-sensitive situations, but emailed motions are strictly rejected. If you need a continuance or have a procedural issue to raise before the hearing, submit it in writing to the clerk's office with enough lead time.
Military-connected cases are common. With Naval Station Norfolk, NAS Oceana, and Joint Expeditionary Base Little Creek nearby, Virginia Beach sees a higher-than-average share of cases involving active-duty military members. If the defendant is on active duty, the Servicemembers Civil Relief Act (SCRA) may require the court to stay proceedings or appoint counsel. This can delay your case significantly — check the Department of Defense Manpower Data Center to verify military status before filing.
Security deposit disputes are frequent. The Virginia Beach rental market generates a steady volume of landlord-tenant small claims cases. If you're suing over a security deposit, know that the 45-day itemization deadline under VRLTA § 55.1-1226 is strictly enforced. The Virginia security deposit small claims post covers the specific rules.

Venue: When Virginia Beach Is the Right Court
File in Virginia Beach General District Court if:
- The defendant lives or has a principal place of employment in Virginia Beach
- The defendant's business has its principal office or business facility in Virginia Beach, or its registered agent is located there
- The contract was performed or the incident occurred in Virginia Beach
Virginia Beach is an independent city — it has its own General District Court, separate from the surrounding cities of Norfolk, Chesapeake, and the counties. Make sure your venue is correct before filing. The defendant can challenge improper venue and force a transfer under Va. Code § 8.01-264.
Service and Posted Service
The Virginia Beach Sheriff's Office handles civil process service. If the sheriff can't locate the defendant after reasonable attempts, the clerk's office can authorize posted service — posting the warrant at the front door of the defendant's usual place of abode.
If your case goes to posted service, you must mail a copy of the warrant to the defendant by first-class mail at least 10 days before trial and file Form DC-413 (Certificate of Mailing Posted Service) with the court clerk on or before the return date. Missing this step means the judge will continue the case to a new date, adding weeks to your timeline.
