Norfolk and Chesapeake Small Claims Court: Filing Guide

Small Claims Filing in Hampton Roads

Norfolk and Chesapeake are independent cities at the heart of Virginia's Hampton Roads region. Each operates its own General District Court with a Small Claims Division — same statewide rules (claims up to $5,000, Form DC-402, with parties generally representing themselves subject to statutory exceptions), but the military-heavy demographics and rental market dynamics of Hampton Roads create some practical differences worth knowing.

Norfolk General District Court

Location: 150 Saint Paul's Boulevard, Room 3202, Norfolk, VA 23510-2747

Norfolk's civil clerk's office handles small claims filings at the counter and by mail. Standard statewide fees: $35–$38 for claims up to $500, $50–$57 for $500.01–$5,000, plus $12 per defendant for sheriff service.

Norfolk is home to Naval Station Norfolk — the world's largest naval base — along with the Norfolk Naval Shipyard and multiple military installations. This means a substantial share of small claims cases involve active-duty service members or military-connected landlord-tenant disputes.

Servicemembers Civil Relief Act (SCRA): If your defendant is on active military duty, the SCRA may require the court to stay (delay) proceedings or appoint an attorney to protect the service member's interests. Before filing, you can check the defendant's military status through the DoD Manpower Data Center. An SCRA stay doesn't kill your case — it pauses it until the service member can participate.

Rental disputes: Norfolk's rental market caters heavily to military families on short rotations. Security deposit cases and early lease termination disputes are among the most common small claims filings. For security deposit claims, the landlord's 45-day itemization deadline under VRLTA § 55.1-1226 applies regardless of whether the tenant is military.

Chesapeake General District Court

Location: 307 Albemarle Drive, Chesapeake, VA 23322

Chesapeake's courthouse is in the Great Bridge area. The civil clerk's office accepts small claims filings during standard business hours. Same fee schedule as Norfolk.

Chesapeake is more suburban and spread out than Norfolk, with a mix of residential subdivisions, agricultural areas, and commercial corridors. Common small claims cases include contractor disputes (both residential and small commercial), property damage from flooding or tree falls (drainage issues are persistent in parts of Chesapeake), and auto repair disagreements.

Venue: Which Court to File In

Norfolk and Chesapeake share a long border. Getting the venue right matters:

  • If the defendant lives in Norfolk, file in Norfolk
  • If the defendant lives in Chesapeake, file in Chesapeake
  • If the defendant's principal place of employment or business, or registered agent, is in one city, that locality may also be a proper venue
  • If the cause of action occurred in one city but the defendant lives in the other, either court may have valid venue under Va. Code § 8.01-262

Other Hampton Roads cities — Virginia Beach, Portsmouth, Suffolk, Hampton, Newport News — each have their own General District Courts. Filing in the wrong city means a possible venue challenge and transfer. Verify where the defendant actually resides, not just where their business operates.

Shared Hampton Roads Considerations

Posted service: Both the Norfolk and Chesapeake Sheriff's Offices handle civil process. If the defendant avoids service, posted service at the defendant's usual place of abode is available. To seek a default judgment, mail a copy by first-class mail at least 10 days before trial and file Form DC-413 with the clerk on or before the return date. This mailing requirement catches Hampton Roads filers off guard, especially in cases involving defendants who have PCS'd (permanently changed station) to another base.

Mediation: Both courts offer voluntary mediation before small claims hearings. It's conducted the same morning, typically before the judge takes the bench for hearings. A mediated settlement becomes a binding consent order.

Business entity defendants: If you're suing a business, check the SCC CIS portal for the registered name and agent. Hampton Roads has many small businesses operating under trade names — a judgment against the DBA instead of the actual owner or entity can be unenforceable.

The Virginia small claims filing guide walks through every step of the process, from drafting a demand letter to collecting after judgment.
