Uniform Civil Rules 2020 South Australia — What Changed for Minor Civil Claims

The Rules That Govern Every Minor Civil Claim

The Uniform Civil Rules 2020 (SA) replaced the old Magistrates Court (Civil) Rules 2013 and harmonised procedural practice across South Australia's Magistrates Court, District Court, and Supreme Court. If you are filing or defending a minor civil claim in 2026, these are the rules that apply.

The change matters for self-represented litigants because old guides, blog posts, and even some government pages still reference the pre-2020 forms and procedures. If you follow outdated instructions, your filing may be rejected.

What Changed

New Form Numbers

The old forms are gone. Current forms were introduced or renumbered under the UCR:

Old form New form Purpose
Form 3 / Form 32 Form 1 + Form 1S Claim and Statement of Claim
— Form 1A Building work claims
— Form 2A Fences Act disputes
Form 76 Form 76B Default judgment application
— Form 31 Multilingual Notice (mandatory)
— Form 42 Affidavit of Proof of Service
— Form 51 + Form 51S Defence shell and Defence Details for electronic filing

If you see a guide referencing "Form 3" or "Form 32," it is using the repealed rules. The CourtSA portal only accepts UCR forms.

Mandatory Pre-Action Notice

The UCR formalised the pre-action requirement under Chapter 13, Rule 332. Before filing a claim, you must send either:

  • A Form P1 Final Notice (lodged via CourtSA, A$27.75 electronic filing fee) — gives the defendant 21 days to pay; the defendant is not required to respond in writing
  • A Rule 332.2 Letter of Demand (free, you draft it yourself) — gives 21 days; the defendant must respond in writing under Rule 332.3

Failing to give the required 21-day pre-action notice may affect your entitlement to costs, including recovery of a filing fee; it does not automatically mean the claim will be struck out.

Mandatory Multilingual Notice (Form 31)

Every claim served on a defendant must include a Form 31 Multilingual Notice — a document informing the recipient of their right to seek translation services and legal aid. Serving without Form 31 is a procedural defect that can invalidate service.

Electronic Filing on CourtSA

CourtSA provides electronic filing for claims, defences, and applications. Some documents may also be lodged physically at the Registry under the Rules. Cash and cheque payments were eliminated in April 2020; CourtSA electronic filings are paid by card at submission.

Check the filing instructions for the form you need, because the permitted filing method depends on the document.

One Amendment Without Leave

Under Rule 334.4, you can amend your claim once without leave of the court before the defendant files a defence. The amended document is marked "Revision 1" and served on the defendant. This is useful if you discover a typo in the amount, need to correct the defendant's name, or want to add a document you forgot to attach.

After a defence is filed, any amendment requires the court's permission.

What Did Not Change

The core architecture stayed the same:

  • The A$12,000 limit for minor civil claims (reduced from A$25,000 in August 2016, before the UCR)
  • No lawyer representation at trial under Section 38 of the Magistrates Court Act 1991
  • The 28-day defence window after service
  • Filing fees are set by the Courts Administration Authority fee schedule (updated 1 July each year)

Why This Matters for Self-Represented Litigants

The UCR standardised procedural rules across all three court levels, though the prescribed form depends on the proceeding and court. That consistency makes the system easier to navigate — once you learn the UCR structure, the same logic applies everywhere.

The SA Minor Civil Claim Guide is built entirely around the Uniform Civil Rules 2020, with every form reference, deadline, and procedure checked against the current rules.
