Small Claims Court Northern Ireland Time Limit

You have been going back and forth with a contractor for months, or sitting on an unpaid invoice hoping the client would eventually pay. At some point, a deadline kicks in — and once it passes, the court will not hear your case no matter how strong your evidence is.

How Long You Have to File

Limitation periods in Northern Ireland are governed by the Limitation (Northern Ireland) Order 1989. For the types of disputes that land in the Small Claims Court, the rules are straightforward:

  • Contract disputes (unpaid invoices, broken agreements, deposit refunds): 6 years from the date of the breach — the date the contract was broken, not the date you discovered it.
  • Property damage (faulty workmanship, neighbour damage, vehicle damage): 6 years from the date the damage occurred.
  • Consumer goods (faulty products, refund refused): for a simple contract claim, 6 years from when the cause of action accrued, such as the date of breach.

The clock stops on the date your application is accepted and issued by the Civil Processing Centre, not the date you post it or submit it online. If you are close to the deadline, leave time for the CPC to process the application and correct any errors.

Engaging in informal negotiations, sending demand letters, or lodging complaints with the Consumer Council does not pause the limitation clock. Keep an eye on the calendar while you try to settle.

What Happens If You Are Late

If the six-year limitation period has expired, a standard simple-contract or property-damage claim is out of time. Get legal advice promptly about the correct accrual date and any facts that affect your case.

If you are unsure whether your claim is in time, count from the specific date of the breach or damage. A contractor who abandoned a job on 15 October 2020 gives you until 15 October 2026 to file.

How Long the Court Process Takes

Once your claim is filed, the timeline depends on whether the respondent disputes it:

Uncontested claims (the respondent does not reply within 21 days):

  • You request a default decree after the 21-day response window closes.
  • The CPC checks service and whether a response was filed before passing the request to a judge; allow time for processing.

Contested claims (the respondent files Form 126A):

  • The CPC transfers the file to your local County Court for a hearing.
  • NICTS customer standards target assigning a hearing date within 10 weeks of receiving a completed application for 90% of disputed cases.
  • After the hearing, 95% of decrees are issued within 4 days.

Total timeline for a contested claim: roughly 3 to 4 months from filing to decree, depending on the court's schedule and whether either party requests an adjournment.

Key Deadlines in the Process

Stage Deadline
Letter before action response window 14–21 days (you set this)
Respondent's time to reply to the court pack 21 calendar days from issue
Request for default decree After the 21-day window closes
Evidence exchange before hearing Set by court directions
Notice of Intent to Enforce (post-decree) 10-day voluntary payment period after the notice is served
Limitation period for most claims 6 years from breach or damage

Procedural deadlines that fall on a weekend or public bank holiday roll to the next operational court business day. Do not assume this extends the six-year limitation period.

Do Not Wait

The limitation period is generous, but evidence degrades over time. Text messages get deleted, witnesses forget details, and contractors disappear. The sooner you file, the stronger your case.

The Making a Small Claim in Northern Ireland guide includes a deadline tracker that maps every critical date — from the demand letter through to enforcement — so nothing slips through.
