Northern Ireland Small Claims Court
What the Northern Ireland Small Claims Court Actually Is
Northern Ireland runs its own small claims system, completely separate from England and Wales. If you have searched online and found references to Form N1, Money Claim Online, or the Civil Procedure Rules — none of that applies here. Northern Ireland operates under the County Court Rules (Northern Ireland) 1981, and the process looks different from start to finish.
The Small Claims Court sits within the County Court tier. It handles monetary disputes up to £5,000, a ceiling that was raised from £3,000 on 3 October 2022. Claims are heard informally by a District Judge, usually without solicitors on either side.
How Filing Works Through the Civil Processing Centre
Every small claim in Northern Ireland is filed centrally through the Civil Processing Centre (CPC) at Laganside Courts in Belfast. You do not walk into your local courthouse to start a case. Whether you file online through the Department of Justice portal or post a paper form, the CPC receives the application, checks it, assigns a reference number, and posts a Small Claims Pack to the respondent.
If the respondent disputes the claim using Form 126A, the CPC transfers the file to the local County Court you selected on the application for a hearing. If the respondent does not reply within 21 days, you can apply for a default decree.
What You Can and Cannot Claim
The court handles two types of claim: liquidated (a fixed amount like an unpaid invoice or withheld deposit) and unliquidated (an estimated loss, such as repair costs for damage caused by a contractor). Claims for the delivery or return of goods valued up to £5,000 also qualify.
Several types of dispute are excluded regardless of amount:
- Personal injury claims, including personal-injury claims arising from road traffic accidents
- Defamation (libel or slander)
- Disputes over land ownership or title
- Property rights arising from marriage
- Claims about legacies or annuities
These claims cannot be brought through the small claims procedure; depending on the claim, they must proceed by an ordinary County Court Civil Bill or a High Court action.

Court Fees and Costs
Filing fees range from £49 for claims up to £300 to £244 for claims over £3,000 and up to £5,000, set by the County Court Fees (Amendment) Order (Northern Ireland) 2026. If you are on a low income or receiving qualifying benefits, you can apply for fee remission using Form ER1.
One important cost rule: solicitor fees are not recoverable from the other side in small claims, regardless of who wins. If you hire a solicitor, that cost stays with you. The court can order the losing side to reimburse your filing fee and reasonable witness expenses, but nothing more.
The Hearing and What Comes After
Hearings are informal. The District Judge asks questions, reviews evidence, and issues a decree — the Northern Ireland equivalent of a judgment. NICTS targets issuing the decree within 4 days of the hearing in 95% of cases.
Here is where many claimants get caught off guard: the court does not collect money for you. A decree is a legal recognition that you are owed money, but if the respondent does not pay voluntarily, you need to take the decree to the Enforcement of Judgments Office (EJO). The EJO can arrange attachment of earnings, orders charging land, or seizure of goods — but each step carries separate fees and paperwork.
Is the Small Claims Court Right for Your Situation?
If someone in Northern Ireland owes you up to £5,000 and informal demands have gone nowhere, the Small Claims Court is the standard route. The process is designed so you can handle it yourself without a solicitor, though nothing stops you from getting legal help if you want it.
For a complete walkthrough of every step — from the pre-action demand letter through filing, the hearing, and handing off to the EJO — the Northern Ireland Small Claims Filing Guide covers the full procedure with printable checklists and worksheets.
