Serving Court Papers in Northern Ireland Small Claims

In England and Wales, claimants sometimes have to arrange service of their own court documents. Northern Ireland works differently — the Civil Processing Centre handles it for you, but the system has specific rules you need to understand before you file.

How Service Works

Once the CPC accepts your application and registers it on the ICOS system, it posts an official Small Claims Pack directly to the respondent by first-class post. The pack includes:

  • Form 125 — the Notice of Action, telling the respondent a claim has been made against them.
  • Form 126A — the Notice of Dispute form, which they fill in if they want to contest the claim.
  • Form 126B — the Notice of Acceptance of Liability, which they fill in if they admit they owe the money but want to propose a payment plan.
  • A copy of your application with all the details of your claim.

You do not arrange service yourself. You do not need a process server. The CPC does it centrally.

Deemed Service

Service is "deemed effective" on the date the pack is posted — not the date the respondent actually receives it. The 21-day response window starts from that posting date, regardless of whether the respondent opens the envelope, reads it, or ignores it.

This is why the address you put on your application matters so much. If you give the wrong address, the pack goes to someone else (or nowhere), and you end up waiting 21 days for a response that was never going to come — then discovering you need to start the service process again.

When Service Fails

If Royal Mail returns the pack to the CPC (marked "not at this address" or "no longer here"), the CPC notifies you. At that point, you need to:

  1. Find a current address. Check Companies House for limited companies (the registered office is public). For individuals, try electoral roll searches, previous correspondence, or trade directories.
  2. Supply the new address to the CPC. The CPC will attempt service again at the updated address.
  3. Apply for alternative service if you cannot find the respondent. This requires a formal application to the court, supported by an affidavit explaining what steps you have taken to locate them. The court may allow service by email or another method — but only with prior judicial authorisation. You cannot decide to serve by email or social media on your own.

Cross-Border Service Within the UK

If your respondent lives in England, Wales, or Scotland, a Northern Ireland resident may still file through the CPC using the standard NI small-claims forms. The CPC arranges postal service to the UK address.

For respondents in the Republic of Ireland or another EU member state, the European Small Claims Procedure is no longer available for new claims after Brexit. For a respondent outside the UK, consult the cross-border rules under Order 71 of the Rules of the Court of Judicature (NI) 1980 before filing.

Getting the Address Right

The most common service failure is a wrong address on the application form. Before you file:

  • Individuals: Verify their current residential address through recent correspondence, delivery notes, or the electoral roll.
  • Sole traders: Name the individual and their trading name (e.g., "John Doe trading as Doe Plumbing Services") at their business or residential address.
  • Limited companies: Use the exact registered name and registered office address from Companies House. Not the trading address, not the shop front — the registered office.

A decree obtained after service to a wrong address can be challenged and set aside, wasting your time and fees.

The Making a Small Claim in Northern Ireland guide includes address verification steps and a service timeline tracker, so you can confirm the respondent's details before filing and track every deadline once the CPC posts the pack.
