Oklahoma Small Claims Demand Letter: Do You Need One Before Filing?

Oklahoma does not require a formal demand letter before you file a small claims case — with one major exception. But judges routinely expect to see proof that you tried to resolve things before dragging the other side into court. Skipping this step can hurt your credibility at the hearing even if it does not technically bar your claim.

The General Rule: No Statutory Requirement

For most contract and tort claims on the small claims docket, there is no statute requiring a pre-filing demand. You could file your Small Claims Affidavit the day after a contractor walks off with your deposit.

That said, judges look for evidence of good faith. When you can show a clear demand letter that the defendant ignored, it strengthens your case. It demonstrates you gave them a chance to make things right. If the defendant settles before the hearing, the demand letter saved you the trip to court entirely.

The Exception: Security Deposit Claims

If you are suing a landlord for a withheld security deposit, a written demand is legally required under 41 O.S. § 115. The statute sets a specific sequence:

  1. After your tenancy ends, send a written demand to the landlord requesting the return of your deposit
  2. Include your forwarding address in the letter
  3. The landlord then has 45 days to return the full deposit or provide an itemized statement of deductions

Your cause of action does not fully exist until those 45 days expire without a proper response. Filing suit before the 45-day window closes is premature, and the court can dismiss it.

You must send this written demand within six months of the tenancy ending. Miss that window and you lose the statutory remedy.

What to Include in a Demand Letter

Whether it is legally required or simply a good idea, an effective demand letter covers:

The facts. State what happened in plain language — dates, amounts, what was agreed to, and what went wrong. Keep it chronological.

The amount. Be specific about what you are owed and how you calculated it. "You owe me $3,200: the $2,000 deposit paid on March 1 plus $1,200 for the replacement contractor I hired after you abandoned the project."

A deadline. Give the recipient a reasonable amount of time to pay — 14 to 30 days is standard. Shorter deadlines look aggressive; longer ones lose urgency.

What happens next. State that you will file a small claims case in the appropriate Oklahoma District Court if the matter is not resolved by the deadline. This is not a threat — it is a factual statement of your next step.

How to Send It

Send the demand letter by certified mail with return receipt requested. This gives you a signed receipt proving the letter was delivered and when. If the case goes to court, you hand the judge the green card along with a copy of the letter.

Keep a copy of everything: the letter, the certified mail receipt, the return receipt (green card), and tracking information. If you also sent the letter by regular mail or email as a courtesy, save those records too.

When Demand Letters Lead to Settlement

In many small claims disputes, the demand letter resolves the problem. A contractor who ignored your phone calls suddenly takes the claim seriously when they receive a formal letter with a deadline and a promise of court action. Landlords who were slow-playing your deposit often return it once they see the 45-day clock and a paper trail.

Even a partial settlement saves both sides time and money. If the defendant offers $2,500 of a $3,200 claim and you accept, you avoid filing fees, service costs, and a day off work.

What If They Ignore It?

If the deadline passes with no response, you file. The demand letter then becomes exhibit one at your hearing — proof that you attempted to resolve the dispute in good faith before coming to court.
