Nebraska Small Claims Demand Letter: How to Write One Before Filing

A demand letter isn't technically required before every small claims case in Nebraska, but skipping it is almost always a mistake. Judges notice when a plaintiff went straight to court without giving the other side a chance to pay. And in security deposit cases under § 76-1416, a written demand is part of the statutory framework.

Beyond the legal optics, demand letters resolve disputes. Many defendants settle once they realize you're serious enough to put it in writing with a court filing deadline attached.

What Your Demand Letter Needs

A complete demand letter covers six elements:

Both parties' full names and addresses. Use the defendant's legal name — if it's a business, the registered entity name from the Secretary of State database at business.nebraska.gov. Addressing a letter to "ABC Plumbing" when the legal entity is "ABC Services LLC" weakens your paper trail.

A clear description of what happened. Stick to facts and dates. "On March 15, 2026, I paid you $3,200 for kitchen countertop installation. The work was not completed. You stopped responding to calls on April 2, 2026." No legal arguments, no emotional language.

The exact amount owed. Itemize it if there are multiple charges: deposit paid, materials purchased, repair costs incurred. Round numbers look made up; documented amounts look serious.

Supporting documentation. Attach copies — never originals — of contracts, receipts, invoices, photos, or text messages that support your claim.

A specific payment deadline. Give 10 to 14 calendar days from receipt. This is long enough to be reasonable but short enough to maintain pressure.

An explicit statement of intent to file. "If payment is not received by [date], I intend to file a claim in Nebraska Small Claims Court." This isn't a threat — it's a factual statement of your next step.

Send It by Certified Mail

Always send the demand letter via certified mail with return receipt requested. The signed green card that comes back proves the defendant received the letter, and it becomes evidence at your hearing. Standard mail, email, or text messages don't give you that proof.

Keep the certified mail receipt, the tracking number, and a copy of the letter itself. When you eventually fill out Form CC 4:1, you'll reference the demand letter in your claim description.

When the Demand Letter Is Especially Important

Security deposit claims. Under Nebraska's Uniform Residential Landlord and Tenant Act (§ 76-1416), a landlord has 14 calendar days after you surrender the premises to return your deposit with an itemized accounting. If they don't comply, a written demand before filing creates a clean timeline that judges expect to see.

Contractor disputes. When a contractor took a deposit and didn't finish the work, the demand letter establishes that you gave them a final opportunity to complete the job or return the money before you involved the court.

Any dispute where the defendant might claim they didn't know about the problem. The demand letter eliminates the "I had no idea" defense.

What Not to Include

Don't threaten criminal charges, don't reference hiring an attorney (attorneys can't appear in Nebraska Small Claims Court anyway under § 25-2803(2)), don't use inflammatory language, and don't overstate your damages. A demand letter that reads like an unhinged rant hurts your credibility if the judge sees it.

If They Don't Respond

No response within your stated deadline is your green light to file. The demand letter and certified mail receipt become part of your evidence package. When the judge asks whether you attempted to resolve this before filing, you hand over the receipts.

The Nebraska Small Claims Filing Guide includes a demand letter framework with the exact elements Nebraska judges expect, plus a service tracking worksheet to keep your certified mail documentation organized from day one.
