Nevada Small Claims Demand Letter: How to Write and Send One Before Filing

Why Nevada Courts Require a Demand Letter

In Clark County — Las Vegas, Henderson, and North Las Vegas — sending a formal written demand letter before filing is a mandatory procedural step. Attach your demand letter and certified mail receipt to the complaint or it won't be accepted.

In Washoe County (Reno and Sparks) and rural townships, the demand letter isn't technically mandatory but is expected by judges and strongly encouraged by local court rules. Walking into a hearing without evidence that you tried to resolve the dispute first puts you at a disadvantage.

What to Include

A demand letter doesn't need legal jargon. It needs three things stated clearly:

  1. The exact dollar amount. Not "roughly $3,000" — state "$3,247.50" or whatever you're owed, broken down by line item if the debt has multiple parts.
  2. The factual basis. What happened, when, and why the recipient owes you money. Reference the contract, lease, invoice, or incident. Keep it to a few paragraphs.
  3. A deadline and consequence. State that you'll file a lawsuit in small claims court if payment isn't received by a specific date. Two to three weeks from the mailing date is reasonable.

Keep the tone professional. This letter may end up in front of a judge.

How to Send It

Certified Mail with Return Receipt Requested. This is the required delivery method for Clark County courts and the expected method everywhere else.

Go to any USPS office, ask for Certified Mail with Return Receipt (the green card). You'll get a tracking number and a receipt. When the recipient signs for the letter, the green card comes back to you with their signature and the delivery date. Both the tracking receipt and the signed green card get attached to your complaint.

If the letter comes back "Refused" or "Unclaimed": Keep the unopened envelope with the USPS tracking stamp intact. File it as your proof of attempted demand. The court accepts refused or unclaimed certified mail as compliance with the demand requirement — the point is that you sent it, not that they read it.

Township-Specific Rules

Las Vegas: The demand must be sent, but there's no waiting period. You can file your complaint the same day you mail the demand letter, as long as the proof of mailing is attached.

Henderson: Wait at least 15 days after mailing before filing. If the letter is returned marked "refused" or "unclaimed," Henderson's instructions allow you to proceed without waiting 15 days. Henderson enforces the demand letter rule strictly.

Reno and Sparks: Strongly encouraged rather than mandatory, but judges will ask whether you attempted to resolve the dispute before filing. Not having a demand letter doesn't get your case dismissed, but it doesn't help either.

Rural townships: Follow the same general principle as Washoe County — send one, even if the local rules don't spell out a requirement.

Common Mistakes

Sending an email or text message instead. Courts want a physical letter sent through USPS Certified Mail. An email thread showing your demands is useful supporting evidence, but it doesn't satisfy the formal demand requirement in Clark County.

Forgetting to keep a copy. You need a copy of the letter itself, the USPS certified mail receipt, and the Return Receipt card. If any of these are missing, you have a gap in your documentation.

Inflating the amount. The demand should match what you plan to claim in court. If your demand says $5,000 and your complaint says $8,000, the judge will notice.

What Happens After You Send It

If the recipient pays, the dispute is resolved without court. If they ignore it, refuse it, or dispute the amount, you file your small claims complaint.

The demand letter becomes Exhibit A in your case file. It shows the judge that you made a reasonable attempt at resolution before bringing the matter to court.
