Nebraska Garnishment Forms and Packets: Complete Filing Guide

Nebraska's garnishment system uses roughly a dozen interrelated forms, and they need to be filed in a specific sequence with the right offices. Getting them wrong — or missing one — can stall your collection for weeks. Here's every garnishment form you need, what it does, and where it goes.

The Core Filing: Form CC 3:6

The Garnishment Affidavit and Praecipe for Summons (Form CC 3:6) is your starting point for both wage and bank garnishments. You file it with the County Court Clerk in the county where the judgment was entered. The form requires you to name the garnishee (the employer or bank), state the remaining judgment balance, and affirm that the judgment is unsatisfied.

The clerk uses your CC 3:6 filing to issue the summons that goes to the garnishee.

The Interrogatories: Form CC 3:8P

Form CC 3:8P is the set of interrogatories — formal written questions — that the garnishee must answer under oath. For employers, the questions cover whether the debtor is currently employed, their pay rate, pay schedule, and disposable earnings. For banks, they cover account balances and whether any protected federal benefits were deposited.

The garnishee has 10 calendar days from service to complete and file the answers with the court.

The Employer Instructions: Form CC 3:8A

Form CC 3:8A (Garnishments, Employer's Instructions) gets served on the employer alongside the interrogatories. It explains the withholding calculations, the difference between the 25% and 15% caps, the $217.50 minimum-wage floor, and how to handle the debtor's pay schedule.

Debtor Notice: Form CC 3:8B

Within seven business days of the clerk issuing the summons, you must mail a copy of the summons, Form CC 3:8B (Notice to Judgment Debtor), and Form CC 3:8N (Request for Hearing) to the debtor at their last known address by first-class mail. This is your obligation, not the court's — skip it and the garnishment can be challenged.

The Continuing Lien Forms

After the employer answers the interrogatories confirming wages exist:

Form CC 3:8D (Application for Continuing Lien) — You file this requesting a 90-day continuing garnishment lien.

Form CC 3:8M (Order of Continuing Lien) — The court issues this order, which keeps the wage garnishment active for 90 days from the date the employer was originally served.

Release and Hearing Forms

Form CC 3:8F (Release of Garnishee) — You file this to end the garnishment once the debt is paid or when you want to stop the garnishment for other reasons.

Form CC 3:8N (Request for Hearing on Garnishment) — This is the debtor's form to challenge the garnishment, claim head-of-family status for the reduced 15% rate, or assert that funds are exempt. It's included in the debtor notice packet you mail.

Form CC 3:8C.1 (Application to Deliver Nonexempt Funds) — Used specifically for bank garnishments after the bank answers the interrogatories. You file this asking the court to order the bank to release the frozen funds to the clerk for disbursement to you.

The Garnishment Packets

Nebraska bundles these individual forms into two reference packets:

Form CC 3:8.20 (Garnishment Packet - Plaintiff/Creditor) — This is the comprehensive instruction guide for judgment creditors. It walks through the entire process from filing CC 3:6 through obtaining the continuing lien. It's a procedural guide, not a form you file.

Form CC 3:8.21 (Garnishment Packet - Defendant/Debtor) — The debtor's version explaining their rights, exemptions, and how to request a hearing.

The Douglas County Variant

If your judgment was entered in Douglas County (Omaha), you'll encounter Form CC 3:8.20.D4 — the localized Douglas County garnishment packet. Douglas County has its own procedural requirements, including specific filing locations at the Douglas County Civic Center and particular evidentiary rules. Always check whether your county uses a localized variant or the statewide standard forms.
