NCAT Evidence Bundle for Respondents: Format and Filing Guide
NCAT does not prescribe a rigid evidence format the way a court does, but disorganised documents lose hearings. A member reading through 80 pages of unlabelled photos, scattered text messages, and unsigned statements will struggle to find the facts that support your defence. An indexed, paginated bundle makes your case easier to follow — and easier to win.
What Goes in a Respondent's Evidence Bundle
Organise your documents into categories:
Contractual documents — the written agreement, quote, terms and conditions, any variations agreed in writing or by email. If there was no written contract, include any text or email exchange that shows what was agreed.
Performance evidence — photos of work completed, delivery receipts, installation records, test results. Date-stamped photos carry more weight than undated ones. If the applicant's photos show a problem, include your own photos from the same date or earlier showing the work in progress.
Financial records — invoices issued, payment receipts, bank statements showing payments received. If the dispute involves the amount owed, a clear payment timeline is critical.
Correspondence — text messages, emails, and letters between you and the applicant, in chronological order. Highlight messages where the applicant acknowledged the work, approved changes, or made requests.
Independent evidence — expert reports, trade assessments, manufacturer specifications, warranty documents. An independent assessment from another tradesperson or an engineer is the strongest evidence for quality disputes.
Witness statements — signed statements from people who can speak to relevant facts (subcontractors who worked on the job, staff who dealt with the customer). Each statement should identify the witness, their relationship to the matter, and the facts within their personal knowledge.
Formatting the Bundle
Number every page consecutively from start to finish. Page 1 is your index; the documents follow in the order listed.
Create a master index at the front. List each document with its tab number, description, date, and page numbers. For example:
| Tab | Document | Date | Pages |
|---|---|---|---|
| 1 | Written quote to applicant | 12 Mar 2026 | 2–3 |
| 2 | Email: applicant approves quote | 14 Mar 2026 | 4 |
| 3 | Photos: work in progress (12 images) | 20 Mar 2026 | 5–16 |
| 4 | Invoice #1042 | 28 Mar 2026 | 17 |
| 5 | Witness statement: J. Smith (subcontractor) | 1 Oct 2026 | 18–19 |
Chronological order within each category. The member needs to follow the timeline of events.
Do not include irrelevant material. Character references, newspaper articles about NCAT, or legal commentary downloaded from the internet add nothing. Every document should directly address a fact in dispute.
Filing and Service Deadlines
If NCAT issues procedural directions requiring you to file an evidence bundle, the deadline in those directions is mandatory. A direction may specify a date such as 14 days before the hearing; follow its wording when calculating the deadline.
File through NCAT Online Services or lodge the bundle in person at an NCAT registry. You must also serve a copy on the applicant by the same deadline. Simultaneous filing and service means both happen on the same day — you cannot file with the tribunal and serve the applicant a week later.
If no directions have been issued, bring three copies of your bundle to the hearing: one for the member, one for the applicant, and one for yourself.

Witness Statements
Each witness statement should contain:
- The witness's full name, address, and occupation
- Their connection to the matter (employee, subcontractor, neighbour)
- The facts they observed, in their own words, in chronological order
- A statement of truth: "I believe the facts stated in this statement are true"
- The witness's signature and date
If a witness's evidence is contested, be prepared for them to attend and answer questions. If a witness is reluctant to attend, you may need to apply for a summons.
The Responding to an NCAT Consumer Claim guide includes a fillable evidence index template, witness statement layouts, and a document checklist for respondents.
