Maryland Garnishment Forms — DC-CV-060, DC-CV-065 and More

Maryland's post-judgment collection system runs on a specific set of District Court forms. Each one does a different job, costs a different fee, and has its own filing requirements. The court clerk can hand you the forms, but they can't tell you which one to file or when — that's up to you.

Here's what each form does and what it costs.

Garnishment Forms

DC-CV-065 — Request for Writ of Garnishment of Wages Use this when you know the debtor's employer. The court issues a writ directing the employer to withhold a portion of each paycheck. Filing fee: $10, plus $60 per defendant for Sheriff/Constable service or $20 if the clerk mails the writ; private-server fees vary. This creates a continuing lien — the employer keeps withholding until the judgment is satisfied. Governed by Maryland Rule 3-646.

DC-CV-060 — Request for Garnishment of Property Other Than Wages Use this for bank accounts and any other non-wage property a third party holds on the debtor's behalf. Filing fee: $10, plus $60 per defendant for Sheriff/Constable service or $20 if the clerk mails the writ; private-server fees vary. The bank freezes funds upon service. Governed by Maryland Rule 3-645.

DC-CV-061 — Confession of Assets This form is filed by the garnishee (the bank or other third party), not by you. After receiving a DC-CV-060 writ, the bank uses this to report to the court how much it froze in the debtor's account. You'll receive a copy.

DC-CV-062 — Request for Judgment — Garnishment After the bank files its Confession of Assets and the debtor's 30-day exemption period expires, you file this to ask the court to release the frozen funds to you. Without it, the money just sits frozen. Don't let the 120-day inactivity clock under Rule 3-645 run out before filing.

DC-CV-066 — Judgment Creditor's Monthly Report Required when you have an active wage garnishment. You must mail this to both the debtor and the employer within 15 days after each calendar month, showing payments received, interest accrued and the remaining balance. Failure to send it can get your garnishment dismissed.

Discovery and Examination

CC-DC-CV-032 — Request for Order Directing Judgment Debtor or Other Person to Appear for Examination in Aid of Enforcement of Judgment The current form states that a debtor may not be compelled to appear in person or answer interrogatories to enforce a small-claims judgment of $5,000 or less, excluding interest, costs and attorney fees. Do not use this form to compel asset disclosure in a small-claims case.

DC-CV-030 — Motion and Order Compelling Answers to Interrogatories Do not use this to compel answers to post-judgment interrogatories on a small-claims judgment; the current CC-DC-CV-032 form states that a debtor may not be compelled to answer interrogatories to enforce such a judgment.

Execution and Liens

DC-CV-040 — Request for Writ of Execution Use this to have the sheriff seize and sell the debtor's physical property (vehicles, equipment, valuables). Filing fee: $10 in most counties, $70 in Baltimore City (includes a $60 sheriff surcharge). You'll also need to advance a sheriff's deposit for towing, storage and advertising.

DC-CV-035 — Notice of Lien / Transmittal of Certified Judgment Use this to record your judgment as a lien against the debtor's real estate. The judgment is transmitted from District Court to the Circuit Court Land Records in the county where the property sits. Fee: $10 transmittal plus $15 Circuit Court recording fee. The lien lasts 12 years.

Closing and Renewal

DC-CV-031 — Notice of Satisfaction File this within 15 days of receiving full payment. If you do not, the debtor can ask the court to declare the judgment satisfied under Rule 3-626; the court may award court costs and reasonable attorney's fees.

DC-CV-023 — Request to Renew Judgment File this before the 12-year judgment expiration to extend enforceability for another 12 years. Fee: $10 per defendant, plus $15 if the judgment is also recorded in Circuit Court.

Which Form Needs MDJ-008?

Any filing that includes restricted personal identifiers — bank account numbers, Social Security numbers, financial account details — must be accompanied by Form MDJ-008 (Notice Regarding Restricted Information). In practice, DC-CV-060 almost always needs it. DC-CV-065 may need it if you're including the debtor's SSN.
