Idaho Small Claims Court Forms After Judgment: Complete List
Idaho's Court Assistance Office (CAO) publishes standardized forms for every step of post-judgment enforcement — but they're scattered across multiple pages on the court self-help website, with no single checklist telling you which ones you need and in what order. Here's the complete form inventory for judgment collection, organized by enforcement action.
All forms are available free as PDF and RTF downloads at courtselfhelp.idaho.gov. The RTF versions are fillable on your computer before printing.
Writ of Execution (Bank Levies and Personal Property)
Use these when you want to seize money from a bank account or take physical possession of the debtor's non-exempt personal property:
| Form | Number | Purpose |
|---|---|---|
| Application and Affidavit for Writ of Execution | CAO SC 9-1 | Your request to the court — states judgment amount, credits, interest, and current balance |
| Writ of Execution | CAO SC 9-6 | The court order the clerk signs, directing the sheriff to levy on specified assets |
| Notice of Garnishment | CAO SC 9-9 | Statutory notice served on the debtor after the levy |
Filing fee: $2 per writ application (paid to the court clerk). You also need written sheriff instructions and sheriff processing fees — those aren't court forms.
Continuing Wage Garnishment
Use these to garnish the debtor's paycheck through their employer. The writ stays active for 90 days:
| Form | Number | Purpose |
|---|---|---|
| Application and Affidavit for Writ of Continuing Garnishment | CAO SC 9-2 | Your request to the court for a wage garnishment writ |
| Writ of Continuing Garnishment | CAO SC 9-7 | The court order served on the employer |
| Notice of Garnishment | CAO SC 9-9 | Statutory notice to the debtor about the wage garnishment |
Same $2 filing fee. The employer also receives interrogatories under I.R.C.P. 69.1(d) requiring them to report the debtor's employment status, pay cycle, and disposable earnings within 5 business days.
Writ of Possession (Specific Personal Property)
Use these when your judgment awards you a specific item — not money — and the debtor won't return it:
| Form | Number | Purpose |
|---|---|---|
| Application and Affidavit for Writ of Possession | CAO SC 9-3 | Your request to the court |
| Writ of Possession | CAO SC 9-8 | The court order directing the sheriff to seize and deliver the property to you |

Exemption Challenge Forms
When the debtor files a Claim of Exemption asserting that the seized property or funds are legally protected:
| Form | Number | Purpose |
|---|---|---|
| Motion Contesting Claim of Exemption | CAO SC 9-4 | Under Idaho Code § 11-203(b), file your challenge within 5 business days from the date the sheriff delivers or mails you a copy of the claim |
| Order on Motion Contesting Claim of Exemption | CAO SC 9-5 | The judge's ruling after the hearing |
| Claim of Exemption | CAO Cv 10-11 | The debtor's form (know what it looks like so you can respond) |
Satisfaction of Judgment
Filed after the judgment is fully paid — principal, interest, and costs:
| Form | Number | Purpose |
|---|---|---|
| Satisfaction of Judgment by Plaintiff | CAO SC 10-1 | You file this acknowledging full payment |
| Motion for Satisfaction of Judgment | CAO SC 10-2 | The debtor files this if you refuse to acknowledge payment |
| Satisfaction of Judgment by Court | CAO SC 10-3 | The court orders satisfaction over a creditor's refusal |
Filing the satisfaction is not optional. Idaho law requires creditors to file it after receiving full payment, and the debtor can ask the court to enter satisfaction through SC 10-2 if you don't.
Debtor Examination Forms
These aren't in the numbered SC 9 series but are available on the same CAO portal:
- Motion and Affidavit for Examination of Judgment Debtor — your request to compel the debtor to disclose assets under oath
- Order for Examination of Judgment Debtor — the court's order compelling appearance
Which Forms You Need First
Most creditors follow this sequence:
- Debtor examination forms (if you don't already know where the debtor works or banks)
- Writ of Continuing Garnishment (SC 9-2 + SC 9-7) for wage garnishment, or Writ of Execution (SC 9-1 + SC 9-6) for bank levies
- Motion Contesting Claim of Exemption (SC 9-4) if the debtor challenges your garnishment
- Satisfaction of Judgment (SC 10-1) when the debt is fully paid
The forms themselves are straightforward — the hard part is assembling complete sheriff packets, writing proper service instructions, and calculating the exact enforcement balance including post-judgment interest. The Idaho judgment collection guide walks through every form with fill-in guidance and pairs each one with the sheriff instruction template the court doesn't provide.
