Idaho Small Claims Answer Form (CAO SC 3-1): How to Fill It Out
The Answer form is the single document that stands between you and a default judgment in Idaho small claims court. It's officially called Form CAO SC 3-1, it's free to file, and you can get it in about two minutes from the state court website.
Where to Get the Form
Download the blank CAO SC 3-1 Answer form from courtselfhelp.idaho.gov under the Small Claims section. You can also pick up a paper copy at any Court Assistance Office in your county courthouse.
A common and expensive mistake: searching "Idaho court answer form" often pulls up the general civil answer form, which carries a $136 filing fee and applies to District Court cases. The small claims Answer form is a separate document with a $0 filing fee. If the form you're looking at mentions a fee over $0, you have the wrong one.
What the Form Asks For
The Answer form is straightforward. You'll fill in:
Case information — Copy the case number, court name, judicial district, and county directly from the summons you received. The plaintiff and defendant names must match the complaint exactly.
Your response — The form gives you a box to explain why you dispute the claim. You don't need to write a legal brief. State the key facts in plain language: what happened, why you disagree with the plaintiff's version, and any evidence you plan to bring. If you admit part of the claim but dispute the rest, say so clearly — specify the dollar amount you agree you owe and explain what you contest.
Your signature and date — Sign and date the form. An unsigned Answer is invalid.
You cannot include a counterclaim on this form. Idaho small claims rules (I.R.S.C.A. Rule 5) prohibit counterclaims within the same case. If the plaintiff actually owes you money, you'd need to file a separate small claims action.
How to Submit It
Three submission methods are available:
Guide & File (online) — At guideandfile.idaho.gov, complete the interactive interview and the system generates a filled-out CAO SC 3-1 for you. The critical step most people miss: you must click through to the final submission screen. Completing the interview only creates the document — it doesn't file it with the court. Defendants who stop at "preview" thinking they're done have lost cases to default judgment.
Paper filing — Print the completed form, make at least three copies (court, plaintiff, your records), and deliver the original to the Magistrate Clerk's counter before 5:00 PM on your deadline day. Mail a copy to the plaintiff or hand-deliver it.
iCourt File & Serve — The formal e-filing portal at idaho.tylertech.cloud/OfsWeb/ is required for business entities (corporations, LLCs, and partnerships) in counties where e-filing is operational. Individual defendants can use it too, though Guide & File is simpler.

The Deadline
Your completed Answer must reach the clerk within 21 calendar days of being served. The date of service is Day 0 — start counting the next day. If the 21st day falls on a weekend or court holiday, your deadline extends to 5:00 PM on the next business day.
A postmark on the 21st day does not count if the Answer arrives later. If you're mailing it, send it early enough that the physical document arrives on time.
What Happens Next
Once filed, the clerk schedules either mandatory mediation or a trial hearing. In many Idaho judicial districts, you'll go through mediation first — a free, confidential session where a neutral mediator helps both sides try to settle. If mediation doesn't resolve things, the case goes to a hearing before a magistrate judge where you present your own evidence and testimony. Attorneys generally cannot represent parties at the hearing; collection agencies appearing as plaintiffs are a statutory exception.
The Idaho small claims response guide includes annotated examples of completed Answer forms, a deadline calculator, and a step-by-step evidence preparation checklist for your hearing day.
