Form P1 Final Notice of Claim South Australia — When and How to Use It
What Form P1 Is
The Form P1 Final Notice of Claim is a court-issued pre-action document in South Australia. It serves the same purpose as a letter of demand — telling the other party you intend to sue and giving them 21 days to pay — but it comes with the weight of the court system behind it. It costs A$27.75 online through CourtSA or A$66.50 at the registry.
Under the Uniform Civil Rules 2020, you must complete one pre-action step before filing a minor civil claim: either a self-drafted letter of demand under Rule 332.2 or a Form P1 Final Notice. Both trigger the same 21-calendar-day waiting period.
When Form P1 Makes Sense
The Form P1 is not required. A properly drafted letter of demand satisfies the pre-action rules at no cost. But Form P1 is worth considering when:
- The respondent ignores informal correspondence. A court-issued notice signals that you have already engaged the court system, which can motivate a response.
- You want cleaner evidence. Because the court issues the Form P1 and records it in the system, it provides conclusive proof of formal statutory notice. A self-drafted letter relies on your own affidavit of delivery.
- The respondent does not need to reply. Under Rule 332.3(3), when you use Form P1, the respondent is explicitly exempt from serving a pre-action written response. You wait 21 days, then file. With a letter of demand, the respondent is obligated to reply — and their failure to do so can be raised later, but it adds a procedural layer.
How to Issue a Form P1
- Log in to the CourtSA portal
- Navigate to the pre-action notice section
- Enter the respondent's legal name and service address
- Enter the claim amount and a brief description of the dispute
- Attach supporting documents — invoices, contracts, or damage assessments
- Pay the A$27.75 online fee by card

After the 21 Days
If the respondent pays within the 21-day window, the matter is resolved. If they do not, you can proceed to file your Form 1 Claim and Form 1S Statement of Claim through CourtSA. The Form P1 fee is recoverable from the respondent as part of the judgment debt if you win.
The SA Minor Civil Claim Guide covers both the Form P1 route and the letter-of-demand route, with templates and a decision framework for choosing between them.
