Carbon County Justice Court Small Claims: What Defendants Need to Know
Carbon County Justice Court in Red Lodge handles small claims cases for the southern Montana county that includes Red Lodge, Joliet, Fromberg, Bridger, and the surrounding rural areas along the Beartooth Highway. If you have been served with a small claims complaint filed here, there are a few local rules that differ from other Montana Justice Courts.
Where and When
Carbon County Justice Court is located at the Carbon County Courthouse in Red Lodge. The court handles both general civil cases and small claims under its small claims division. As with all Montana small claims courts, the jurisdictional limit is $7,000 and attorneys are prohibited unless all parties have counsel.
Hearings are typically scheduled within the 40-day statutory window. The drive to Red Lodge from Billings is about 60 miles, and from Bridger about 30 miles — plan for weather if your hearing falls during winter months.
The Pre-Suit Demand Letter Requirement
Carbon County has a local rule that many other Montana counties do not: the plaintiff must send a certified pre-suit demand letter and attach proof of delivery to the small claims complaint. If you are reviewing the papers served on you, check whether a copy of this demand letter and a certified mail receipt are included.
If the plaintiff did not send a pre-suit demand letter, or failed to attach proof, that is worth raising at the hearing. Local procedural requirements exist for a reason, and a plaintiff who skipped the demand step may not have followed the proper Carbon County filing process.
Filing Fees and Defendant Costs
Carbon County follows the standard fee schedule:
- Plaintiff's filing fee: $30
- Defendant appearance fee: check with the clerk at check-in (local schedules vary)
- Counterclaim filing fee: $30
- Fee waiver: available for defendants who cannot afford the fees — submit an Affidavit of Inability to Pay to the clerk before or at the hearing
If you plan to file a counterclaim, it must be served on the plaintiff at least 72 hours before the scheduled hearing time. The counterclaim cap is $6,500.

Service Rules in Carbon County
Carbon County local rules specify that a small claims defendant must be served within the county. This is narrower than general civil actions, which allow statewide service. If you were served outside Carbon County, you may have grounds to challenge jurisdiction.
The standard five-day minimum between service and hearing still applies. Verify that your papers show at least five full days between the date of service and your hearing date.
Preparing for a Carbon County Hearing
The hearing will be before a Justice of the Peace, not a jury. Bring three copies of every document you plan to present — one for yourself, one for the judge, and one for the plaintiff. The Carbon County courthouse does not have a copying service, so make your copies before arriving.
Red Lodge is a small community. The courtroom is informal, but the outcome is binding. Dress respectfully and address the Justice of the Peace as "Your Honor" or "Judge."
