Billings Small Claims Court (Yellowstone County): Defendant Guide
Billings is Montana's largest city, and Yellowstone County Justice Court handles more small claims cases than most other counties in the state. If you have been served with a small claims complaint in Billings, the court process follows the same statewide rules — but the volume of cases here means the court moves quickly and the docket is tight.
Where the Court Is
Yellowstone County Justice Court is located in Billings. The small claims division operates as a track within the Justice Court, not as a separate building. When you arrive for your hearing, check in with the clerk's office and pay any required defendant appearance fee.
Billings is the commercial center of eastern Montana, so many defendants have shorter travel times than in rural counties. If you live in Laurel, Shepherd, or Huntley, plan for a 15- to 30-minute drive.
What Billings Small Claims Cases Look Like
With a larger population comes a wider variety of disputes. Common Billings small claims cases include:
- Contractor and home repair disputes — unpaid invoices, incomplete work, damage during renovation
- Landlord-tenant security deposit claims — withholding disputes and damage deductions; landlords generally have 30 days to provide an itemized list and refund under MCA § 70-25-202, with a 10-day deadline when there are no damages, cleaning charges, unpaid rent, or unpaid utilities
- Vehicle sale disputes — undisclosed mechanical problems in private sales, title delivery delays
- Business-to-customer disagreements — service quality, refund demands, warranty issues
The $7,000 jurisdictional limit applies to all of these. If the amount at stake exceeds $7,000, the case should be in the general civil division (limit: $15,000) or District Court.
Key Deadlines and Fees
The statewide deadlines apply in Yellowstone County:
- 10 days after service: deadline to file a Notice of Removal (transfers the case to the civil division, where attorneys are allowed and jury trials are available)
- 72 hours before the hearing: counterclaim service deadline (cap: $6,500)
- 5 days before the hearing: the plaintiff must have completed service on you
Under MCA § 25-35-608, the statutory fee is $10 for a defendant who appears and contests the complaint or files a counterclaim. Yellowstone County lists a total $30 fee for filing a small-claims complaint; contact the clerk for any additional counterclaim charge. Fee waivers are available through an Affidavit of Inability to Pay.

Hearing Preparation
Billings courtrooms are busier than small-county ones. The Justice of the Peace may have several cases scheduled back-to-back, so your hearing may start later than the time on your notice. Bring all of your evidence organized and ready — you may not get a second chance to present something you left at home.
Three copies of each document: one for the judge, one for the plaintiff, one for yourself. Photographs should be printed, not shown on a phone screen (though some judges will accept a phone if you also have prints).
Arrive early, dress respectably, and address the judge as "Your Honor." The hearing is informal — no formal rules of evidence, no cross-examination in the traditional sense — but the judge's decision is legally binding and enforceable.
After the Hearing
If the judgment goes against you, Yellowstone County has active judgment enforcement mechanisms — wage garnishment, bank levies, and property liens are all available to a prevailing plaintiff. If you cannot pay the full amount immediately, the guide covers your options for negotiating a payment plan or understanding what assets are exempt under Montana law.
