West Virginia Small Claims Court: Serving Papers on the Defendant

Why Service of Process Matters

Before a West Virginia Magistrate Court can exercise jurisdiction over your case, the defendant must be formally notified — served with the summons and complaint. Self-mailing a copy via regular first-class mail does not count. The court arranges service through official channels, and the method used must meet the requirements of Magistrate Civil Rule 3.

If service isn't completed within 6 months of the initial complaint filing date, the court must dismiss the action without prejudice under Rule 18(a).

Method 1: Certified Mail (Default)

This is the standard and cheapest option. After you file, the Magistrate Assistant mails the summons, complaint, and your attached exhibits via certified mail, restricted delivery, return receipt requested. Cost is approximately $20 per defendant.

Service is legally complete on the date the defendant (or their authorized agent) signs the green return receipt card. The signed card goes into the court file as proof.

This method works well when you have a reliable address for the defendant and they're likely to accept mail. It fails when:

  • The defendant refuses to sign
  • The letter is returned unclaimed
  • The address is wrong or the defendant has moved

Method 2: Sheriff Personal Service

If certified mail fails, your next step is requesting sheriff personal service. The Sheriff of the county where the defendant lives physically hand-delivers the documents to the defendant or to an adult at their usual place of residence. Cost: $25–$30 per defendant.

Sheriff service has a higher success rate than certified mail because the Sheriff actively locates the person. However, it requires a physical street address — PO Boxes don't work for personal service. If the defendant's only known address is a PO Box, you'll need to find an alternative address through property records, the Secretary of State's business search, or other public records.

Method 3: Private Process Server

Any non-party resident of West Virginia who is at least 18 years old can serve as a private process server. They hand-deliver the documents and then sign an Affidavit of Service detailing the date, time, and location of delivery.

There's no court fee for this method — you pay the server directly (prices vary). It's useful when you need service done quickly or in a location where the Sheriff's office has a backlog.

Method 4: Secretary of State Service (for Business Entities)

If you're suing a corporation or LLC that has a registered agent in West Virginia, service goes to the agent. If the entity hasn't maintained a registered agent or the agent can't be found, you can serve through the West Virginia Secretary of State under W. Va. Code § 31D-1-150.

The clerk sends two copies of the process to the SOS with a $25 fee ($20 to the SOS, $5 to the clerk). The SOS then forwards the documents via certified mail to the corporation's principal office.

Method 5: Service by Publication (Last Resort)

When the defendant's location is genuinely unknown — and you've made diligent efforts to find them — you can request an Order of Publication (Form SCA-M45). You must file an Affidavit of Due Diligence showing what you tried: address searches, phone calls, visiting the last known address, checking public records.

If approved, notice is published as a legal advertisement in a local newspaper. You pay the publication fees directly. This method satisfies constitutional notice requirements, but a money judgment obtained purely through publication service has limited enforceability.

When Service Fails: Don't Wait

The 6-month dismissal clock starts running on the day you file. If certified mail comes back unserved in week two, don't sit on it. Immediately request sheriff service or find a private process server. Every week of delay eats into your window.

Track service attempts and their outcomes. The West Virginia Small Claims Filing Guide includes a service tracking log designed for exactly this — recording dates, methods, results, and next steps so nothing falls through the cracks.
