West Virginia Small Claims Filing Fees: Complete Cost Breakdown

Filing Fee Tiers for 2026

West Virginia Magistrate Court filing fees are set by W. Va. Code § 50-3-1 and tiered by the dollar amount you're claiming.

Amount Claimed Filing Fee
$0.01 – $500 $50
$500.01 – $1,000 $55
$1,000.01 – $2,000 $60
$2,000.01 – $20,000 $70
Non-monetary claims $50

The $20,000 cap reflects the increase under House Bill 2761 (effective July 2025). Claims in the former $10,000.01–$20,000 band carry the same $70 fee as the $2,000.01–$10,000 tier.

Service of Process Costs

On top of the filing fee, you pay to get the defendant formally notified:

Certified mail (default method): approximately $20 per defendant. The Magistrate Assistant handles this — you don't mail it yourself.

Sheriff personal service: $25–$30 per defendant. Used when certified mail fails or you want the certainty of hand delivery.

Private process server: no court fee, but you pay the server directly. A non-party West Virginia resident aged 18 or older can serve.

Secretary of State service: $25 total ($20 to the SOS, $5 to the clerk). Used for corporate defendants that haven't maintained a registered agent in West Virginia.

Other Court Costs

  • Witness subpoena: $0.50–$1.00 per witness, plus statutory mileage
  • Photocopies: $1.00 per page
  • Appeal to Circuit Court: $200 filing fee

Calculating Your Total Upfront Cost

For a typical case — say you're suing one defendant for $3,500 and using certified mail:

  • Filing fee: $70
  • Certified mail service: ~$20
  • Total: approximately $90

If certified mail fails and you switch to sheriff service, add $25–$30. Suing two defendants doubles the service cost but not the filing fee.

If you win, filing fees, service costs, and subpoena expenses are assessed against the losing party as part of the judgment.

Payment Methods

For a mailed filing, include a certified check or money order for the required fee. For an in-person filing, check the county clerk's current payment instructions before you go.

When Fees Change

Filing fee tiers are set by statute and don't change often. The last major change was HB 2761 in 2025, which expanded jurisdiction but left the fee schedule intact. The Supreme Court of Appeals can adjust administrative surcharges, so it's worth confirming current fees with the clerk's office if you're filing months after reading this.

If filing fees are a barrier, West Virginia offers a fee waiver through a financial affidavit — covered in detail in our fee waiver guide.

For a worksheet that calculates your total filing and service costs based on claim amount and number of defendants, the West Virginia Small Claims Filing Guide includes a tiered fee calculator you can fill in before heading to the courthouse.
