West Virginia Judgment Collection Forms — Every Form You Need

West Virginia's court forms portal has the PDFs but no roadmap for using them. If you've won a judgment in Magistrate Court and need to enforce it, here's every form that matters for post-judgment collection — what each one does, when you need it, and in what order.

The Starting Point: SCA-MI 600

Form SCA-MI 600 (Enforcement of Civil Judgments Information Sheet) is the court's own overview of post-judgment enforcement. It covers the 20-day waiting period, your options for collecting, and the general sequence. It's a reference document, not something you file — but read it before you start.

All forms are available on the West Virginia Judiciary's official portal at courtswv.gov under Magistrate Court Forms.

Enforcement Forms

Form SCA-C&M640NP (Affidavit for Suggestee Execution): This is your wage garnishment application. You fill in the debtor's name, address, employer, and redacted Social Security number, then file it with the Magistrate Court Clerk along with a $5 fee. The clerk issues the suggestee execution and it's served on the employer.

Writ of Execution (no standardized form number): You request this from the Magistrate Court Clerk to direct the County Sheriff to seize and sell the debtor's personal property. The clerk prepares the writ based on your application. Filing fee: $5.

Suggestion (bank garnishment): You request a Suggestion summons through the Magistrate Court to reach funds held by a bank or other third party. The summons is served on the financial institution, which must answer within 21 days.

Abstract of Judgment: A certified summary of your judgment, requested from the Magistrate Court Clerk and recorded with the County Commission Clerk to create a real estate lien. You need one abstract per county where the debtor owns property.

Post-Judgment Discovery

Rule 27 Interrogatories: Not a standardized form — you draft written questions compelling the debtor to disclose their employer, bank accounts, real property, and other assets. Filed through the Magistrate Court, served on the debtor, answered under oath.

Closing the Case

Form SCA-M657 (Release of Judgment): Once the debtor pays in full, you sign this form (notarized or acknowledged before a clerk or notary) and file it with the Magistrate Court Clerk. If you recorded a judgment lien, you must also record a certified copy of the release with each County Commission Clerk where the abstract was filed.

Forms You Don't Need (Pre-Judgment Only)

A common mistake: grabbing the wrong form because the naming convention is confusing. These are pre-judgment filing forms and have no role in collection:

  • SCA-M207 (Civil Complaint) — for initiating a lawsuit
  • SCA-M208 (Civil Complaint - Commercial Creditor / Contract Action) — for business plaintiffs filing a case
  • SCA-M225 (Answer) — for defendants responding to a complaint
  • SCA-M429 (Affidavit: Default Judgment) — for requesting judgment when the defendant fails to answer

Appeal-Related Forms

If the debtor appeals (or you need to understand the appeal process):

  • SCA-M1250-1 (Appeal Process Information) — overview of 20-day appeal deadlines and procedures
  • SCA-M111-1P (Petition for Appeal of Bench Trial) — for appealing to Circuit Court

These only matter if the debtor is challenging the judgment. Once the appeal window closes without action, enforcement forms are all you need.

The judgment collection guide includes the complete form directory with step-by-step instructions for each filing, plus a sequenced checklist so you know exactly which form to file when.
