VCAT Fence Dispute and Neighbour Damage Claim in Victoria

Fence Disputes and Neighbour Damage: Where to File in Victoria

Your neighbour's tree dropped a branch on your fence, or they refuse to share the cost of replacing the boundary fence. You want to take it to VCAT. But here's the thing — VCAT's Civil Claims List probably isn't where this goes.

Victoria has separate forums and processes depending on the type of neighbour dispute. Filing in the wrong place wastes your application fee and adds months of delay.

Dividing Fence Disputes

Fence disputes between neighbours are governed by the Fences Act 1968 (Vic), not the consumer and trader legislation that covers VCAT's Civil Claims List. The process has its own pathway:

  1. Serve a Fencing Notice on your neighbour. This is a formal written proposal setting out the type of fence, the estimated cost, and each party's share.
  2. If your neighbour doesn't respond within 30 days or disagrees, try free mediation through the Dispute Settlement Centre of Victoria (DSCV). The DSCV provides voluntary, no-cost mediation for neighbourhood disputes across Victoria.
  3. If mediation fails, you can apply to the Magistrates' Court of Victoria under the Fences Act. The Magistrates' Court has specific jurisdiction over fencing orders.

Standard boundary-fence disputes under the Fences Act 1968 go to the Magistrates' Court, not a VCAT "Fences List".

Neighbour Property Damage Claims

If your neighbour's actions caused direct financial damage — their tree roots cracked your driveway, their renovation debris damaged your property, or their dog destroyed your garden — the question is whether there's a contractual relationship.

No contract between you and your neighbour (most neighbour damage situations): These are tort claims (negligence, nuisance, or trespass). Tort claims between private individuals generally go to the Magistrates' Court of Victoria for amounts up to $100,000.

A contract exists (rare in neighbour disputes, but possible if you hired the same contractor and they damaged your property): If the dispute involves a supply of goods or services under contract, it may fit in VCAT's Civil Claims List.

For most neighbour property damage, start with the DSCV's free mediation service before heading to court.

When Your Dispute Actually Fits VCAT's Civil Claims List

Some disputes that feel like "neighbour problems" are actually consumer disputes that belong at VCAT:

  • You hired a contractor to build a retaining wall along the boundary and they did faulty work (goods and services dispute — Civil Claims List, or Building and Property List if it's domestic building work).
  • A business next door supplied a product that damaged your property (consumer guarantee claim — Civil Claims List).
  • Your landlord won't return your bond (Residential Tenancies List — separate from the Civil Claims List).

If your dispute does fit the Civil Claims List, the filing fee for claims up to $15,000 is $202.10 at the standard rate or $67.40 on concession. You file online through the myVCAT portal.

Our VCAT Civil Claim Filing Guide covers the complete process for Civil Claims List applications — from verifying your dispute fits, through the demand letter, to preparing your hearing bundle.
