How Long Does Small Claims Court Take in South Dakota?

When you get served with a small claims case in South Dakota, the first question is usually "how long is this going to take?" The short answer: the court part moves faster than most people expect. The collection part can drag on much longer.

Service to Hearing: The Clerk Sets the Date

South Dakota small claims follows a court-set timeline. Under SDCL 15-39-54, the clerk of courts sets a specific hearing or response date and must give the defendant at least five court days' notice from the date of service.

Court days exclude weekends and state holidays. If you receive certified mail on a Monday, the earliest your hearing could land is the following Monday (assuming no holidays fall between). The clerk's notice gives the date to follow; do not rely on a statewide estimate of how long scheduling will take.

Scheduling practices vary by circuit. High-volume urban courts such as Minnehaha County (Sioux Falls) and Pennington County (Rapid City) often use block scheduling, while rural courts may schedule individual hearing times.

The Hearing Itself

Small claims hearings are informal proceedings before a Magistrate Judge or Clerk Magistrate. There is no jury or formal discovery beforehand. Specific written requests may still be needed for matters such as a continuance or remote appearance. Both sides present their evidence, question witnesses, and make their case.

The time required depends on the case and how much evidence and testimony each side presents. The magistrate may rule from the bench or take the matter under advisement and issue a written decision later.

After the Ruling: The 30-Day Stay

Once judgment is entered, execution and garnishment cannot start for 30 days unless the court entered a default judgment or issued a special order allowing immediate enforcement. This stay gives the losing party time to pay voluntarily.

If the losing party pays, the winner files Form UJS-019 (Satisfaction of Judgment) to close the case on the court record.

What If the Loser Doesn't Pay?

This is where "how long" gets complicated. If the judgment debtor doesn't pay after the 30-day stay expires, the judgment creditor can pursue garnishment under SDCL 21-18-1 or file a property lien under SDCL 15-16-7. A South Dakota small claims judgment remains enforceable for 10 years and can be renewed for another 10 years under SDCL 15-16-33 and SDCL 15-16-34.

The actual collection timeline depends entirely on the debtor's financial situation — someone with steady wages and bank accounts can be garnished relatively quickly, while someone with limited attachable assets may take months or years.

No Appeal — So the Clock Stops at Judgment

One important piece of the timeline: under SDCL 15-39-57, small claims judgments in South Dakota cannot be appealed by either side. The magistrate's decision is final. Both parties waive the right to appellate review by staying in small claims court rather than transferring to the regular civil docket before trial.

This means there is no post-trial appeal period eating up additional months. If unpaid, the judgment may still be enforced for 10 years and renewed once.
