South Dakota Small Claims Court Security Deposit: How to Sue Your Landlord
Your landlord kept the deposit, sent no itemized statement, and stopped answering messages. This is the most common type of small claims case tenants file in South Dakota, and the statute makes the landlord's obligations very specific.
The Two Deadlines Under SDCL 43-32-24
After the tenancy ends and the landlord receives your mailing address or delivery instructions, your landlord has:
21 days to either return the full deposit or provide a written statement showing the specific reason for withholding any portion.
45 days after the tenancy ends (if you request it) to provide an itemized accounting of any deposit withheld.
These are hard deadlines. A landlord who misses the 21-day window forfeits the right to withhold any part of the deposit — even if there was legitimate damage.
Punitive Damages: The $200 Bonus
The statute allows punitive damages of up to $200 for bad-faith retention or a bad-faith failure to provide the required written statement or itemized accounting. The court decides whether the landlord acted in bad faith.
You may request the deposit as actual damages and up to $200 in statutory punitive damages on form UJS-008. Court costs are awarded separately to the winner.
Step-by-Step: Filing the Claim
1. Send a demand letter. Cite SDCL 43-32-24 and the specific deadlines the landlord missed. Send it by certified mail with return receipt requested. Give the landlord 7–14 days to respond.
2. Gather your records. You'll need:
- Your lease agreement
- Proof of deposit payment (bank statement, receipt, cancelled check)
- Move-out date documentation
- Proof you provided a forwarding address
- The demand letter and certified mail receipt
- Photos of the unit's condition at move-out (if you took them)
- Any communication where the landlord acknowledged the deposit or refused to return it
3. File the claim. Complete forms UJS-008 and UJS-232. If the landlord is an individual, file in the county where the landlord resides or where the cause arose (usually the county where the rental property is located). If the landlord is a corporation, LLC, or partnership, file in a county where the entity has a place of business. The filing fee is based on the total amount claimed: $24.84 for claims up to $100, $30.84 for $100.01–$1,000, $40.84 for $1,000.01–$3,999.99, and $42.84 for $4,000–$12,000.
4. The clerk serves the landlord. The court sends your claim by certified mail. If the landlord refuses or the mail bounces, arrange sheriff or private process server delivery.
5. Attend the hearing. Present your lease, deposit proof, the demand letter, and the certified mail receipt. If the landlord did not timely provide a written statement showing the specific reason for withholding, the statute says the landlord forfeits the right to withhold any part of the deposit.

What the Landlord Might Argue
"There was damage beyond normal wear." The landlord must prove the deductions with documentation — repair receipts, contractor invoices, photos. Without the required timely written statement showing the reason for withholding, the landlord forfeits the right to withhold any part of the deposit.
"The tenant didn't provide a forwarding address." The 21-day clock starts when the landlord receives the forwarding address. If you sent it by certified mail, you have proof of delivery.
"The tenant broke the lease early." Early termination doesn't eliminate the landlord's obligation to return the deposit minus legitimate, documented deductions within the statutory window.
Commercial Deposits
Commercial deposits follow different deadlines under SDCL 43-32-24.1: the landlord has 60 days after tenancy termination and receipt of your mailing address or delivery instructions to return the deposit or provide a written statement showing the reason for withholding; if you request it, the landlord has 90 days after termination to provide an itemized accounting. Failure to comply forfeits the right to withhold, and bad-faith violations can support punitive damages up to $200.
