Solicitor Costs in Small Claims Court Northern Ireland

One of the biggest fears for anyone facing a small claim in Northern Ireland is that they will end up paying the other side's legal fees on top of the claim itself. The small claims costs rules generally limit that risk, with exceptions for unreasonable conduct and proceedings handled as a civil bill.

The Costs Rule

Order 26 Rule 43 generally limits costs in a small claim to the appropriate court fee. The judge may award costs for unreasonable conduct under Rule 45; if the case is transferred to the civil bill list, Rule 33 makes scale costs apply. Rule 45 also allows costs in proceedings properly started by ordinary civil bill. So solicitor fees are usually not recoverable by either side, but the exceptions matter.

This is deliberate. The small claims process is designed for litigants in person — people representing themselves without a lawyer. The general restriction on costs reduces the risk of a disproportionate legal bill hanging over an informal hearing about a few hundred or thousand pounds.

What You Can Recover

The usual recoverable amounts in small claims are:

  • Court fees — the judge may award the appropriate court fee paid by the successful party
  • Expert witness expenses for an expert who provided written or oral evidence at the judge's request under Rule 37

These are the usual recoverable items. Travel costs, lost earnings for attending the hearing, photocopying, and postage are not ordinarily recoverable under Rules 43 and 44; the Rule 45 exceptions above can affect costs in an individual case.

When Hiring a Solicitor Might Still Make Sense

The usual restriction on recoverable costs does not prevent you from hiring a solicitor. Be prepared to pay the solicitor yourself, although a judge can award costs in the exceptions described above. Some situations where it may be worth the investment:

Complex counterclaims. If you are disputing a £4,500 building defect claim and counterclaiming for the cost of remedial work, a solicitor can help structure your response and evidence. High-street solicitors in Northern Ireland are reported to charge £150–£300+ per hour, so ask for a quote before instructing.

Limited-company respondents. A company can represent itself through a director, but if the claim involves contractual interpretation or consumer rights, a solicitor's input on the defence grounds can be valuable.

Set-aside applications. If you missed the 21-day deadline and need to apply to set aside a default decree, the application involves a Statement of Truth and a fee of £189. Getting the grounds right matters because a failed set-aside means the decree stands.

Before instructing a solicitor on a claim under £2,000, compare their quote with the amount at stake; legal fees are generally not recoverable, and the informal hearing format is designed to accommodate self-representation.

Civil Legal Aid

Civil legal aid does not cover Small Claims Court representation in Northern Ireland. The Legal Services Agency NI administers legal aid, but the small claims procedure is specifically excluded. Fee exemptions and remissions (through Form ER1) cover court fees only — not the cost of a solicitor.

Free advice is available from Advice NI (0808 802 0020), Citizens Advice, and Law Centre NI, though high demand can mean waiting lists that exceed the 21-day response deadline.

The Bottom Line

The costs rule in Northern Ireland small claims generally favours self-representation, but the judge may award costs in the exceptions above. You are also unlikely to recover your own solicitor's fees if you win. For most respondents, the money that would go to a solicitor is better spent on getting organised — a structured response, a clear evidence bundle, and a confident hearing presentation.

The Responding to a Small Claim in Northern Ireland guide gives you the same procedural framework a solicitor would walk you through, at a fraction of the cost.
