Served with a claim in Northern Ireland — and the deadline is already ticking
A padded envelope from Laganside Courthouse is not something you were expecting. Inside is a small claims pack — Form 125, a claim for money, a deadline you need to calculate, and legal language nobody explained. You have 21 calendar days to respond. Miss it, and the claimant walks away with a default decree against you.
The court website has your forms. What it does not have is a walkthrough that tells you which form to pick, what to write on it, how much detail the judge actually wants, or what happens if you get it wrong.
The NI Response Roadmap — every step from the envelope to the outcome
The Responding to a Small Claim in Northern Ireland guide turns the response process into a structured sequence. Instead of piecing together fragments from NIDirect, StepChange, and English advice that does not apply, you work through one document — written entirely for Northern Ireland's Civil Processing Centre, the County Court Rules (NI) 2002, and the £5,000 small claims limit.
The guide is 51 pages across 13 chapters, plus a printable response checklist. It is not legal advice and it does not predict outcomes. It is a procedural roadmap that helps you respond correctly, on time, and with the evidence organised the way the District Judge expects it.
What is inside the guide
- Small claims pack decoder — what Form 125 actually says, how to read the claim type (liquidated vs unliquidated), and how to verify the papers are genuine before you respond
- 21-day deadline calculator and postal log — work out your exact response date, track Royal Mail Recorded Delivery references, and keep a communication log for every call to the Civil Processing Centre
- Form 126A walkthrough (dispute) — how to set out your defence, what level of detail to include, how to frame a set-off argument, and how to lodge a counterclaim within the £5,000 limit
- Form 126B walkthrough (admission) — how to propose an instalment plan, what income and expenditure details the court expects, and the credit consequences of an admission decree
- Submission mechanics — where to post, hand-deliver, or submit online; what address to use; what to keep as proof
- Hearing preparation — how small claims hearings run in Northern Ireland, building your evidence bundle, written statements, witness evidence, expert report deadlines (14 days before the hearing), and what costs you can and cannot recover
- Settlement and mediation — how to settle before the hearing date, direct payment before judgment, and the mediation options available
- Post-decision procedures — understanding the decree, setting aside a default decree (Form 129), applying for a review, appealing (Form 130), and enforcement through the Enforcement of Judgments Office
- Four worked scenarios — homeowner sued by a contractor, tenant-landlord deposit dispute, customer suing a small business, and private vehicle sale dispute — each showing what to include in the defence
- Court fees and exemptions — what fees a respondent might face, and how to apply for exemption or remission using Form ER1
The free checklist covers the steps — the guide covers the how
The free Northern Ireland Small Claims Response Checklist gives you the 21-day deadline, the three response forms, and the key contacts. It is useful on its own — many respondents only need a reference sheet to stay organised.
The full guide goes deeper. It walks through each form field by field, explains the credit implications of each response route, and covers the procedures you need if the straightforward response does not end the matter — default decrees, set-aside applications, appeals, and enforcement.
Who this guide is written for
- A homeowner served with a claim by a contractor or tradesperson over disputed work or an unpaid invoice
- A tenant or landlord dealing with a deposit, repair, or rent arrears dispute that has reached the Small Claims Court
- A small business owner or sole trader who has been sued by a customer over goods or services
- A private seller sued over a vehicle or goods sale — especially if you assumed "sold as seen" protected you
- Anyone who has missed the 21-day deadline and needs to understand the default decree set-aside process
Who this guide is not for
If you have been sued by a bank, credit card company, debt buyer, or collection agency over a consumer debt, this guide is not designed for that situation. Free, specialist help is available from Advice NI (028 9064 5919) and StepChange. This guide also does not cover family law, employment, or personal injury claims.
Why search results keep leading you to the wrong procedure
Most "UK small claims" content online is written for England and Wales. It references Money Claim Online, Form N9, the Civil National Business Centre in Northampton, and a 14-day or 28-day response window. None of that applies in Northern Ireland. The forms are different (125, 126A, 126B), the deadline is different (21 days), the processing centre is different (Laganside Courthouse in Belfast), and the post-decision enforcement is handled by the EJO, not county court bailiffs.
AI assistants compound the problem — Copilot and other tools regularly tell Northern Ireland searchers to "file their defence on Form N9" or "respond through HMCTS." Following that advice does not count as filing a response with the Civil Processing Centre.
This guide covers only Northern Ireland civil procedure. Every form number, deadline, fee, court office, and enforcement step is specific to the County Court system under the County Courts (NI) Order 1980 and the County Court Rules (Northern Ireland) 2002.
