How Much Does a Solicitor Cost for a Simple Procedure Claim in Scotland?
What Solicitors Charge for Small Claims in Scotland
Scottish solicitors typically charge between £200 and £350 per hour plus VAT for civil litigation work, including Simple Procedure claims in the Sheriff Court. Some firms offer fixed-fee packages for drafting a Claim Form 3A, usually ranging from £150 to £450 plus VAT, but these rarely cover the full process. Court filing fees (£23 for claims up to £300, or £127 for claims between £300.01 and £5,000), service charges, hearing representation, and post-decree enforcement are almost always billed separately.
The arithmetic gets uncomfortable quickly. For a claim worth £1,500, a solicitor billing at £250 per hour could eat through the entire claim value in six hours of work. And even if you win, statutory expenses caps under Simple Procedure limit what you can recover from the other side.
Why Expenses Caps Matter
Simple Procedure has strict limits on how much you can recover in legal costs from a losing respondent:
- Claims of £300 or less: no expenses recoverable at all
- Claims between £300.01 and £1,500: capped at £150
- Claims between £1,500.01 and £3,000: capped at 10% of the claim value
- Claims between £3,000.01 and £5,000: uncapped, but subject to Rule 3.7 percentage reductions under the Taxation of Judicial Expenses Rules 2019
On top of these caps, the Cabot Financial v Walls ruling from May 2025 requires a mandatory 10% deduction on all allowed charges, plus a further 50% reduction for claims under £1,000 or 25% for claims between £1,001 and £2,500.
This means a solicitor's bill is largely your expense to bear, especially for lower-value claims.
When Self-Filing Makes Sense
Simple Procedure was designed for exactly this situation. The Sheriff Court created it as a speedy, inexpensive, and informal process under the Courts Reform (Scotland) Act 2014, and the Civil Online portal walks you through every section of Form 3A. Court staff can help with administrative questions (though they cannot give legal advice), and Citizens Advice Scotland bureaux offer free form completion assistance.
Self-filing works well when your claim is straightforward — an unpaid invoice with a paper trail, a contractor who took a deposit and disappeared, or a refund that a retailer refuses to process. You need clear documentation and a claim that fits within the £5,000 limit.

When a Solicitor Is Worth It
There are situations where professional help earns its fee. Complex cases involving multiple respondents, disputed liability, or tricky jurisdictional questions (like suing an English-registered company from Scotland) benefit from legal expertise. Claims near the £5,000 ceiling also make solicitor fees more proportionate, and the expenses cap lifts above £3,000.
Some solicitors offer unbundled services — drafting your Claim Form for a fixed fee while you handle the rest yourself. This gives you professional help on the hardest part without paying for full representation.
Another option is the Advice and Assistance scheme through the Scottish Legal Aid Board. If you meet the financial eligibility criteria, this can cover initial solicitor advice and help with claim preparation.
The Middle Ground
For claims between £1,000 and £3,000, a structured self-help approach often hits the right balance. You prepare your claim using a step-by-step guide, draft your Form 3A offline to avoid portal mistakes, and handle service and the hearing yourself. The filing fee is £127, and your total out-of-pocket stays under £200 even with recorded delivery service costs.
If something unexpected happens during the case — the respondent files a counterclaim or raises a jurisdictional challenge — you can bring in a solicitor at that point for targeted advice, rather than paying for full representation from day one.
The Simple Procedure Claim Guide covers every stage of the process, from the demand letter through enforcement, so you can make an informed decision about where professional help is actually needed.
