Small Claims Court in St. Charles County, Missouri
Filing Small Claims in St. Charles County
St. Charles County sits in Missouri's 11th Judicial Circuit, and its small claims division handles monetary disputes up to $5,000 under RSMo § 482.305. Under § 482.330, venue is proper where a defendant resides; where the plaintiff resides and the defendant can be found; or where the transaction or tort occurred. If one of those grounds points to St. Charles County, it is a filing venue.
The county has grown rapidly — it's one of the largest suburban counties in the St. Louis metro area — and its courthouse handles a high volume of associate circuit cases. Knowing the logistics before you show up saves time and prevents wasted trips.
Courthouse Location and Contact
The St. Charles County Circuit Court is at 300 N. 2nd Street, St. Charles, MO 63301. Small claims cases are filed through the Associate Circuit Clerk's office in Room 223 on the main floor.
The clerk's office is open Monday through Friday, 8 a.m. to 5 p.m. Call ahead if you're filing in person: (636) 949-3079.
Filing Fees and Service Costs
An 11th Circuit fee schedule published in 2021 lists a $20.50 filing fee and $10 certified-mail fee per defendant; confirm current charges with the clerk.
Service of process is an additional cost:
- Certified mail: $10 per defendant on the published schedule, handled by the clerk's office
- Sheriff service: $49 for the first party and $40 for additional parties at the same location and case number, including $9 mileage, under the St. Charles County Sheriff's fee schedule effective March 1, 2026
Pay the filing fee and service fee together at the time of filing. The clerk accepts cash, cashier's check, or money order for in-person filings. If you file electronically through Missouri's eFiling system, payment is handled online.

How to File
You have three options:
In person. Bring your completed Petition (OSCA Form SC40), the Confidential Case Filing Information Sheet, and payment for filing and service fees to the Associate Circuit Clerk's office. The clerk date-stamps your petition and assigns a case number on the spot.
By mail. Mail the signed petition, confidential information sheet, a check for the filing and service fees, and a self-addressed stamped envelope for the return of your process copies to the St. Charles County Circuit Clerk at 300 N. 2nd Street, St. Charles, MO 63301.
eFiling. Self-represented litigants can file through Missouri's statewide eFiling system at courts.mo.gov. Register an account, upload your petition as a PDF, and submit payment electronically. Track your case on Case.net after filing.
Service of Process
Once the clerk accepts your petition, they issue a summons. The defendant must be served at least 10 days before the hearing date. If the certified-mail return receipt is not signed by the addressee, it does not provide the proof of service described in § 482.350. Check the docket and ask the clerk whether to request an alias summons for another authorized service method, such as sheriff service.
For defendants within St. Charles County, the St. Charles County Sheriff's Office handles civil process. For defendants outside the county, the summons is sent to the sheriff in the county where the defendant lives.
What to Expect at the Hearing
Small claims hearings in St. Charles County follow the standard Missouri procedure. The hearing is informal — no jury, relaxed evidence rules. The judge will ask the plaintiff to present first, then the defendant.
Bring three copies of all your evidence: one for the judge, one for the opposing party, one for yourself. Organize documents chronologically with a simple index.
If the defendant has been duly served and doesn't appear, you still must present a prima facie case; the judge may enter a default judgment under RSMo § 482.355. If either party disagrees with the ruling, they have 10 days to file an Application for Trial de Novo under RSMo § 482.365, which gets a fresh hearing in the Associate Circuit Court.
Fee Waiver Option
If you can't afford the filing fees, you can petition for a fee waiver using OSCA Form GN10 (Motion and Affidavit to Proceed as a Poor Person). Attach documentation of your income and expenses. An Associate Circuit Judge reviews the application and either waives the filing fee or denies the request with a 10-to-14-day window to pay.
The fee waiver covers the clerk's filing deposit. It does not cover sheriff service fees or other third-party costs.
