Small Claims Court in Oklahoma City: Filing at Oklahoma County Courthouse

Oklahoma County is the busiest jurisdiction in the state for small claims cases. If the defendant lives in the county or the dispute happened here, you file at the Oklahoma County Courthouse in downtown Oklahoma City. Here is the practical information you need.

Courthouse Address and Hours

Oklahoma County Court Clerk 320 Robert S. Kerr Avenue, Room 409 Oklahoma City, OK 73102

The Court Clerk's counter handles small claims filings during regular business hours. Arrive early — the building has a security screening at the entrance, and the clerk's window can have a wait, especially on Monday mornings and the first business day after a holiday.

Parking

Paid parking lots and garages surround the courthouse on Robert S. Kerr Avenue and nearby streets. Metered street parking is available but fills quickly during morning docket calls. Plan for $5–$15 depending on how long you stay. Budget at least 15 extra minutes for finding a spot and getting through the security line.

Filing Fees in Oklahoma County

Oklahoma County's total filing fees run higher than most counties because of local surcharges:

Claim amount Total filing fee
Up to $5,000 ~$58
$5,001–$10,000 $225.39

The jump at $5,000 is steep. If your claim is near that line, consider whether the exact amount you are claiming pushes you into the higher tier.

Service fees are separate:

  • Certified mail (clerk-issued): $10–$18.88 (restricted delivery costs more)
  • County sheriff: $50
  • Private process server: $50–$100 (market rates)

How to File

For a paper filing, bring the completed Small Claims Affidavit and Order to Room 409. You need:

  • The original signed affidavit (sworn before a notary or the clerk)
  • Two copies per defendant
  • One copy for your records
  • Payment for the filing fee and service method

The clerk stamps the original, assigns a case number, and sets the hearing date. Oklahoma County says small claims affidavits are set within 60 days. You will receive a copy of the order with the hearing date and time filled in.

OSCN e-filing accounts are limited to Oklahoma attorneys, state agency representatives, and licensed process servers; pro se registrations are not accepted. Self-represented plaintiffs should file paper documents at the Court Clerk's counter or ask the clerk about filing by mail.

Service of Process

The clerk can send your documents via certified mail with restricted delivery ($10–$18.88). If you choose sheriff service ($50), a deputy from the Oklahoma County Sheriff's Office personally delivers the papers. Both methods must be completed at least 10 days before the hearing.

If certified mail comes back unclaimed or unsigned, service has failed. You will need to request a continuance and an Alias Order to try again — usually through sheriff or private process server.

Hearing Day in Oklahoma County

Oklahoma County small claims dockets are called at 9 a.m. Arrive on time — if you are not present when your case is called, the judge may dismiss it. If the defendant does not appear and service was valid, you can request a default judgment on the spot.

Bring three copies of every document: one for the judge, one for the defendant, and one for yourself. Organize everything chronologically — contracts first, then correspondence, then receipts and photos.

The judge makes the decision. A jury is available only when the claim, counterclaim, or setoff exceeds $1,500; the request requires written notice and a $50 deposit at least two working days before the date set for the defendant's appearance under 12 O.S. § 1761.
