Small Claims Court in Fort Smith, Arkansas: Sebastian County Filing Guide

Sebastian County District Court — Fort Smith and Greenwood

Sebastian County has two district court departments. The Fort Smith Department, located at the Sebastian County Courts Complex on 901 South B Street, handles cases within the city. The Greenwood Department covers the rest of the county. File in whichever department serves the area where the defendant lives or where the dispute occurred.

Both departments hear small claims up to $5,000 under A.C.A. § 16-17-704. No attorneys are permitted in the Small Claims Division — if the defendant's attorney enters an appearance or files a responsive pleading, the case transfers to the Civil Division automatically.

One detail that sets Fort Smith apart: small claims hearings are held on Wednesdays. Confirm your assigned hearing date with the clerk and plan around that weekly docket.

Fees and Copy Rules

The Fort Smith Department publishes clear fee schedules:

Item Cost
Small claims filing fee $65
Civil Division filing fee $80 + $2.50 summons
Sheriff service $50 per person/address
Subpoena issuance $2.50 each
Writ of execution or garnishment $10 each
Certified copies $5 per document
Photocopies $0.25 per page

Bring three complete copies of your complaint and all attachments. If you show up short, the clerk charges $0.25 per page to make copies for you. That adds up fast when you have a stack of receipts and photos.

How to File

Pick up the complaint form from the Fort Smith clerk's office. There is no statewide standard form — each department uses its own. Fill out the defendant's full legal name, address, a plain-language description of the dispute, and the dollar amount you are requesting.

If you are suing a business, verify the exact legal name and registered agent through the Arkansas Secretary of State Business Entity Search. Naming the business wrong can make your judgment unenforceable.

Pro se filers are exempt from the eFlex electronic filing system under Administrative Order No. 21. You file on paper, in person or by mail. Emailing or faxing your complaint to the clerk does not count as a legal filing.

Service of Process

You have 120 days from filing to serve the defendant under ARCP Rule 4(i). You cannot hand-deliver the papers yourself.

In Sebastian County, the most common methods are:

  • Sheriff service — $50 per defendant/address, handled by the Sebastian County Sheriff's Office; the deputy delivers the papers and files a Return of Service
  • Certified mail with restricted delivery and return receipt — the defendant must personally sign the green card
  • Private process server — requires a court order under ARCP Rule 4(c)

If certified mail returns unclaimed or the sheriff cannot locate the defendant, request an alias summons and try another method. The defendant must be served at least 10 days before the Wednesday hearing date.

What Happens at the Hearing

Fort Smith's Wednesday small claims docket is informal. You tell the judge what happened, present your evidence, and answer questions. The other side does the same. Keep your presentation straightforward and focused on the evidence.

Bring all evidence in three printed sets. The judge will not accept evidence on your phone. Contracts, invoices, photos, text messages, and bank statements all need to be on paper.

If the defendant does not answer within 30 days of service, you can request a default judgment. After the docket entry of judgment, the losing party has 30 calendar days to appeal to Circuit Court under District Court Rule 9 — a $165 fee and a fresh trial from the start.
