Small Claims Court in Benton County, Arkansas: Bentonville and Rogers Filing Guide

The Benton County District Court

Benton County is part of the 19th Judicial District and has one of the busiest district courts in Northwest Arkansas. The court handles small claims for Bentonville, Rogers, Siloam Springs, Centerton, Bella Vista, Lowell, Pea Ridge, and unincorporated areas throughout the county.

Small claims in Benton County follow the same statewide rules as every other Arkansas district court: a $5,000 maximum under A.C.A. § 16-17-704, no attorneys allowed in the Small Claims Division, and pro se filing only.

Venue rules require you to file in the district court department covering a proper venue location, such as where the defendant lives or where the dispute arose. If you live in Rogers but the contractor who took your deposit is based in Bentonville, confirm with the clerk which department covers the address or dispute location before filing.

Filing Fees and What to Bring

Arkansas small claims filing fees range from $30 to $65; confirm Benton County's current base fee with the clerk. Additional costs include service fees, writ issuance, and certified copies; confirm the current local amounts with the clerk.

When you visit the clerk's office, bring:

  • Three complete copies of your complaint (original plus copies for you and the defendant)
  • Three copies of every attachment — contracts, invoices, photos, receipts
  • The defendant's full legal name and physical address
  • A check, money order, or cash for the filing fee (call ahead to confirm accepted payment methods)

If the defendant is a business, verify the exact legal name and registered agent through the Arkansas Secretary of State Business Entity Search before filing. Suing "Bob's Roofing" when the registered name is "Robert Smith d/b/a Bob's Roofing LLC" can create enforcement problems down the line.

Service of Process in Benton County

You have 120 days from filing to serve the defendant under ARCP Rule 4(i). You cannot serve the papers yourself.

The most common methods:

  • Certified mail, restricted delivery, return receipt requested — the defendant signs the green card personally; if someone else signs or the mail comes back unclaimed, it does not count
  • Benton County Sheriff — the clerk routes the summons to the sheriff's office for personal delivery; expect a service fee around $50
  • Private process server — only with a court order under ARCP Rule 4(c)

If your first attempt fails, contact the clerk about the next service step and do not let the 120-day deadline expire. If service is not completed in time, the action can be dismissed without prejudice unless the court extends the deadline for good cause.

The Small Claims Hearing

Benton County's small claims hearings are informal. You present your case directly to the district judge, explain what happened, and hand over your evidence. The judge asks questions, hears the other side, and decides.

Print every piece of evidence in triplicate. The judge will not scroll through your phone. Bring the original contract, repair estimates, bank statements showing payments, photos with dates, and any text messages or emails printed on paper.

If the defendant does not show up after valid service, you can request a default judgment. If you win and the defendant wants to appeal, they have 30 calendar days from the docket entry of judgment to file a de novo appeal in Circuit Court — a $165 filing fee and a brand-new trial from scratch.
