California Small Claims Advisory Services (Free Help Before Your Hearing)

California law (CCP § 116.940) requires every county to run a Small Claims Advisory Service — free procedural help for people filing or defending small claims cases. These advisors are one of the best-kept resources in the court system, but they have hard limits on what they can do for you.

What Small Claims Advisors Actually Do

Advisors help with the mechanics of your case: which forms to fill out, where to file, how to serve the defendant, and what deadlines to track. They can explain the court process, review your completed paperwork for obvious errors, and tell you what evidence to bring to the hearing.

They cannot:

  • Represent you in court
  • Tell you whether you'll win
  • Evaluate the strength of your evidence
  • Draft legal arguments for you
  • Organize your evidence binder

This isn't a policy choice — it's a legal restriction. Advisors are not your attorney, and their help stops at procedural guidance.

How to Reach Your County's Advisory Service

Contact information varies by county. The statewide directory at courts.ca.gov lists each county's advisory service with phone numbers and hours. Here are the major counties:

Los Angeles County (DCBA): The Department of Consumer and Business Affairs runs the Small Claims Legal Advisor program. Phone: (213) 974-9759, Monday–Friday 8:00 AM–4:30 PM. Its main office is at 500 W. Temple St., Room B-96, Los Angeles. Confirm current walk-in availability before visiting. Expect long hold times — LA handles an enormous volume of small claims cases.

San Diego County: Small Claims Legal Advisor at the Central Division, Hall of Justice, 330 W. Broadway, Room 224. Phone: (858) 634-1777; phone hours are Monday–Friday 8:30 AM–12:30 PM and 1:30–4:30 PM. Walk-in hours are Monday–Thursday 8:30–10:30 AM, and live chat is available when an advisor is online. Note the strict limits: 30-minute consultations, maximum 6 visits (3 hours total) per 30-day period.

Orange County: Call the Small Claims Advisor at (714) 845-7560 or (714) 571-5200. Confirm current hours and locations when you call.

San Francisco: ACCESS Center at 400 McAllister Street, Room 509. Limited walk-in capacity.

Court-Connected Mediation

Many California Superior Courts offer free or low-cost mediation on the day of your hearing. A neutral mediator sits down with both parties and tries to reach a settlement before the case goes before the judge.

Mediation is voluntary — both sides have to agree to participate. If you reach an agreement, make sure it is put in writing and follow the court's process for making it enforceable. If mediation does not resolve the dispute, the case may proceed before a judge if it is scheduled for that day.

The advantages are real: mediation lets both sides negotiate creatively (payment plans, partial refunds, continued service) rather than getting a binary win/lose judgment. And settlements are often easier to collect because the defendant agreed to the terms.

Community mediation centers — like the National Conflict Resolution Center in San Diego — also handle small claims disputes before or after filing, sometimes at no cost. County law libraries can point you to local programs.

When to Call the Advisory Service

Call early — ideally before you file. An advisor can confirm you're naming the right defendant, filing at the right courthouse, and not missing a statute of limitations deadline. These are the mistakes that derail cases, and a 15-minute phone call can prevent them.

After filing, call again if you're unsure about service methods or deadlines. The advisor can walk you through the timing for your specific hearing date.
