Simple Procedure Response Deadline Scotland — The 21-Day Rule
Where to Find Your Deadline
The exact date is printed on Form 3D — the timetable issued by the Sheriff Clerk when the claim was registered. It is labelled "last date for a response." That date is the one that counts, not any estimate you calculate yourself.
The standard window between service and your response deadline is 21 calendar days. Calendar days means every day counts — Saturdays, Sundays and public holidays are included in the count. The deadline does not pause over weekends.
How the Service Date Works
When the claimant serves papers by recorded delivery post, the legal service date is the next working day after the date of posting, not the day you actually collect the letter. If papers were posted on Thursday 1 October, the service date is Friday 2 October, and the 21-day clock starts from 3 October.
When papers are delivered by a sheriff officer in person, the service date is the day they physically hand you the documents or deposit them at your address.
Keep the envelope, postal tracking slips and any delivery receipts — these are evidence if a dispute arises over whether service was valid.
Weekend and Holiday Extensions
If the last date for a response falls on a Saturday, Sunday, public holiday or any day the Sheriff Court office is closed, the deadline extends automatically to 17:00 on the next working day the court is open. You do not need to apply for this — it happens by operation of law.

Submission Cutoff Times
The cutoff depends on how you submit:
- Civil Online: your response must be fully submitted (not just saved as a draft) before 23:59 on the last date for a response
- Paper at the court counter: before the counter closing time, typically 16:00 or 17:00
- Paper by post: the form must physically arrive at the Sheriff Court by the deadline, not just be posted before it
If there is any risk of a paper submission arriving late, submit through Civil Online instead. The digital timestamp is your proof.
What If You Need More Time
If you cannot meet the 21-day deadline — because of a medical emergency, being abroad, or needing time to gather documents — you can apply for a timetable extension before the deadline expires.
The application is made using Form 3E (Change of Timetable Application). In it you explain why you need more time, propose a new response date, and confirm you have sent a copy to the claimant.
Submitting Form 3E does not automatically extend anything. The original deadline stays live until the Sheriff formally grants the extension and issues an updated order. If the Sheriff refuses or has not ruled before the original deadline passes, you must still get Form 4A in on time or risk a decision in absence.
What Happens When the Deadline Passes
If you file nothing, the claimant can lodge Form 7A (Application for Decision) within two weeks. The Sheriff then reviews the papers and can grant a decision in absence — a decree for some or all of the amount claimed, plus any expenses awarded — without ever hearing your side.
There is a narrow window: if you discover you have missed the deadline but the claimant has not yet filed Form 7A, contact the Sheriff Clerk immediately and lodge your Form 4A. The Sheriff has discretion under Rule 1.8 to accept a late response if doing so is fair.
Once a decree is granted, your only route is a Form 13B recall application, which requires a reasonable excuse for the delay and a completed Form 4A attached. You get only one recall attempt per case.
The safest approach is simple: find the date on Form 3D, count backwards enough days to leave yourself time to draft your response, and submit early.
The Scotland Simple Procedure response guide includes a deadline calculator worksheet and walks through every step from the moment you receive the papers to the options after a decision.
