How Long Does Simple Procedure Take in Scotland?
The Short Answer
Most undefended Simple Procedure claims resolve in roughly eight to twelve weeks from the day you submit your Claim Form on Civil Online. Defended claims that go to a hearing typically take four to six months. Those timelines stretch if you hit service problems, if the respondent asks for time to pay, or if the Sheriff orders additional case management steps.
Nothing about Simple Procedure is automatic, though. The court does not chase deadlines for you. Missing the Form 7A deadline after no response requires dismissal; other dates carry the consequences set out in Form 3D or the court's orders.
Filing to Registration: One to Two Weeks
After you submit Form 3A through Civil Online, the Sheriff Clerk reviews it for competence — correct parties, proper jurisdiction, fee paid. Straightforward claims usually clear this check within five to ten working days. If the Clerk spots an error (wrong court district, missing fee exemption form, unclear claim narrative), the system rejects the filing and refunds your court fee. You fix the problem and resubmit, which adds another week or more.
Once registration goes through, the court generates Form 3D — your timetable. It sets two critical dates: the last date for service and the last date for the respondent to reply.
Service: Three Weeks Minimum
Form 3D gives you a window to serve the respondent. The rules require service at least 21 calendar days before the last date for response. You have three options: ask the Sheriff Clerk to post it (£15 plus the Sheriff Officer's fee; individual claimants, including sole traders, can request this), use recorded delivery through a solicitor or Sheriff Officer, or instruct a Sheriff Officer for personal service.
The Clerk's service is by recorded-delivery mail. If it fails, the court will tell you; if you want to continue, the claim must then be served by a Sheriff Officer for an additional fee.
If postal service fails, the court will tell you; if you want to continue, the claim must then be served by a Sheriff Officer. If the respondent's address remains unknown after reasonable steps to find it, use Form 6B (Service by Advertisement Application). Use Form 9A to ask the court to change the timetable if you need that order.

Response Period: Use Form 3D
The respondent must act by the last date for response shown on Form 3D. They can dispute the claim (Form 4A), admit it and request instalments (Form 5A), or pay you directly.
If they do nothing, the claim becomes undefended. But the court does not hand you a decree automatically — you have to apply for one.
Undefended Route: Two More Weeks
When no response arrives, you lodge Form 7A (Application for a Decision) within 14 days of the last response date. Miss that window and the Sheriff must dismiss your claim under Rule 13.5. Before the decision, submit an account of any expenses you claim; if you are unrepresented, use the SCTS Expenses Claim Form pro-forma with Form 7A.
The Sheriff Clerk processes Form 7A within about one to two weeks. If everything is in order, you get your decree. Total elapsed time on the undefended route: roughly eight to twelve weeks from filing.
Defended Route: Months Longer
If the respondent files Form 4A disputing the claim, the Sheriff considers the case and may refer the parties to alternative dispute resolution, arrange a Case Management Discussion or hearing, decide the case without a hearing, or dismiss the claim. If a Case Management Discussion is ordered, it is typically set four to eight weeks after the response.
At a Case Management Discussion, the Sheriff might order negotiation, refer you to mediation, or set a full hearing date. Full hearings are usually listed another four to eight weeks out, depending on court availability.
You need to lodge your evidence list (Form 10A) and witness list (Form 11A) at least 14 days before the hearing. After the hearing, the Sheriff can issue a decision on the day or reserve it for up to four weeks.
What Drags the Timeline Out
Several things can push your case past the typical window. A respondent who is hard to trace requires alternative service orders. A time-to-pay application (Form 5A) adds a two-week objection window, and if the Sheriff grants instalments, you wait months or years for full payment. Adjournments requested by either side or ordered by the Sheriff can add weeks each time. And enforcement after decree — instructing Sheriff Officers to collect — is a separate process with its own timeline.
Keeping Your Claim on Track
The Scotland Simple Procedure filing guide includes a Service and Timetable Tracker worksheet that converts your Form 3D dates into a step-by-step calendar. It flags every deadline — service, response, Form 7A, evidence lists — so nothing slips past.
