Service of Documents WA Minor Case — Rules, Methods and Interstate Deadlines

Why Service Matters to Respondents

The way court papers were served on you determines two things: when your response deadline starts, and whether the service was legally valid in the first place. If service was defective, the entire timeline may be wrong — and you may have grounds to challenge any default judgment entered against you.

In the Magistrates Court of Western Australia, the Magistrates Court (Minor Cases Procedure) Rules 2005 and the Magistrates Court (General) Rules 2005 set out exactly how a minor case claim must be delivered to a respondent.

Valid Methods of Service

There are four recognised methods for serving a minor case claim in WA:

Personal service. The claimant (or their agent) hands the document directly to you. If you refuse to take it, placing it down in your presence counts. This is the strongest form of service because there is no doubt you received it.

Bailiff service. The claimant pays the court bailiff to serve the documents. The bailiff records the service on a Form 10 Certificate of Proof of Service. Personal bailiff service costs $117.50; postal bailiff service costs $57.50.

Postal service. The claim is sent by prepaid post to your residential address or principal business address. For companies, it goes to the registered office. Service by post is deemed effective on the date the document would arrive in the ordinary course of post — not the date it was sent.

Substituted service. If the claimant cannot serve you by any normal method, they can apply to the court for an order allowing service by email, social media, or another method. This requires a court order — a claimant cannot just decide on their own to serve you by email.

The 14-Day and 21-Day Deadlines

Your response deadline depends on where the claim was served:

  • Served within Western Australia: 14 calendar days
  • Served interstate (anywhere else in Australia): 21 calendar days, under section 16 of the Service and Execution of Process Act 1992 (Cth)
  • Served overseas: The court sets the deadline by specific direction

In all cases, the countdown starts the day after legally effective service. The service date is day zero. Weekends and public holidays count as regular days in the tally, but if the final day falls on a weekend or WA public holiday, the deadline rolls to the next business day at 5:00 PM WST.

Challenging Defective Service

If the claimant did not follow the rules — posted documents to an address that is not valid for service, failed to serve you personally when personal service was required, or used an unauthorised method without a court order — the service may be defective. Defective service does not automatically void the claim, but it can be grounds to set aside a default judgment or argue your response deadline never started running.

Evidence of defective service includes:

  • An envelope postmarked to an address you no longer live at
  • A bailiff certificate showing service on a person who is not you
  • Documents delivered by email when no substituted service order exists

If you believe service was defective, raise it immediately when you file your Form 15A or at the status conference. For serious service disputes, consider getting advice from Legal Aid WA or a community legal centre.

Preserving Your Service Evidence

Keep everything related to how you received the claim:

  • The postmarked envelope (if served by post)
  • Any delivery confirmation or tracking receipt
  • A note of the exact date, time, and circumstances of personal service
  • The bailiff's Form 10 certificate if one was produced

This evidence protects you if there is ever a dispute about when your 14-day or 21-day clock started. If the claimant applies for a default judgment and you believe the deadline has not actually expired, your service evidence is what supports that argument.

The WA Minor Case Response Guide includes a deadline calculation worksheet that accounts for service location, weekend rollovers, and public holidays — so you know your exact filing date before you start on Form 15A.
