Served with Small Claims Papers in Nevada — What to Do First

Someone just handed you court papers, and you have about thirty seconds of calm before the adrenaline kicks in. Before you do anything else — call anyone, pay anything, or panic about deadlines — sit down and actually read what's in the envelope.

What's in the Packet

A Nevada small claims service packet typically includes:

  • Small Claims Application and Declaration of Complaint — the plaintiff's statement of what happened and how much they want (up to $10,000 under NRS 73.010).
  • Order to Appear or Summons — the court date, time, courtroom number, and address. This is your mandatory appearance date.
  • Court instructions — a sheet explaining your options and any mediation requirements.
  • Supporting exhibits — contracts, invoices, photos, or estimates the plaintiff attached.

Look for the case number, the court's official seal or stamp, and the hearing date. If any of these are missing, something may be wrong with the papers — but don't ignore them.

Verify the Papers Are Real

Scam artists sometimes send fake court notices to pressure people into paying. Before you respond to anything:

  1. Find the court's contact information independently — search the court name online rather than calling numbers printed on the papers.
  2. Access the court's public docket system. Clark County uses the Odyssey Public Access Portal. Washoe County courts have their own online lookup.
  3. Confirm the case number, your name, and the hearing date match what's in the system.

If the case doesn't appear online yet, that doesn't automatically mean it's fake — clerk indexing can take a few days. But never send money through links or phone numbers on the papers without verifying through the court directly.

Check Who Served You

Service in Nevada may be made by a sheriff, constable, licensed process server, or any person at least 18 years old who is not a party to the action. Certified mail may be authorized by the court as an alternate service method in some situations. If the plaintiff handed you the papers directly, that's not valid service — but you should still respond rather than ignore the case, because the court may not agree with your objection.

If you were served at a wrong address, or someone else accepted the papers at your home, note the details. You can raise service defects at your hearing or through a formal motion to dismiss — but ignoring defective service is risky. The court may still enter a default judgment against you.

Find Your Hearing Date and Court

Your papers will name a specific justice court. Nevada small claims cases are heard in the Justice Court of the township where you live, work, or where the dispute happened. The major courts:

  • Las Vegas Justice Court — Regional Justice Center, 200 Lewis Ave, Las Vegas
  • Henderson Justice Court — 243 S. Water St, Henderson
  • Reno Justice Court — 1 S. Sierra St, Reno
  • Sparks Justice Court — 630 Greenbrae Dr, Sparks

Mark the hearing date on your calendar immediately. Missing it triggers a default judgment — the judge rules for the plaintiff without hearing your side.

What Not to Do

Don't ignore the papers. Don't assume paying the plaintiff directly closes the case (it doesn't, unless a formal dismissal is filed). Don't call the clerk expecting legal advice — clerks can confirm dates and fees but are prohibited from advising you on strategy.

And don't assume you need a lawyer. Nevada small claims court is designed for self-represented people, and under NRS 73.040, attorney fees generally aren't recoverable even if you win.

The Nevada Small Claims Response Guide covers the full process from verifying your papers through the hearing and what happens after the judge's decision.
