How to Respond to Small Claims Court in Nevada

Getting served with small claims court papers in Nevada is stressful, but the process is simpler than most people expect. You don't need a lawyer, you usually don't need to file a written answer, and the $10,000 jurisdictional cap under NRS 73.010 means the stakes are contained. What matters most is showing up.

You Probably Don't Need to File a Written Answer

This is the biggest misconception Nevada defendants have. In general civil cases, you'd need to serve a formal answer within 21 days. Small claims works differently.

Under Las Vegas Justice Court Local Rules (LVJCLRP 5.6(a)), no written answer is required. The same is true at Sparks, Reno, and Henderson justice courts. Your primary obligation is to appear at the hearing or mandatory mediation session on the date listed in your papers.

That said, some courts offer optional answer forms. Las Vegas Justice Court provides a fillable Small Claims Answer form, and filing one lets you organize your defense ahead of time. It's just not mandatory to preserve your right to contest the claim.

Your Five Response Options

Nevada defendants have five paths after being served:

  1. Appear and defend. Show up on the hearing date with your evidence and tell your side. This is the most common approach.
  2. File a motion to dismiss. If there's a jurisdictional problem — wrong court, expired statute of limitations, or defective service — you can raise it by motion before the hearing.
  3. File a counterclaim. If the plaintiff owes you money from the same dispute, you can file your own claim for up to $10,000. JCRCP 88(b) generally sets a 21-day deadline after service; local rules also set cutoffs, including 5 days before trial in Las Vegas and 7 days before mediation in Sparks.
  4. Settle before the hearing. You can negotiate directly with the plaintiff or use court-connected mediation. If you reach an agreement, file a stipulated judgment with the court.
  5. Admit and pay. If you agree you owe the money, you can pay the plaintiff before the hearing. But you must confirm a Notice of Voluntary Dismissal gets filed — paying alone doesn't close the case.

Key Deadlines by Court

Deadlines vary depending on which justice court handles your case:

  • Las Vegas Justice Court: Counterclaims due 5 days before trial. Motions to continue due 5 days before trial. Voluntary mediation available on trial day through the Neighborhood Justice Center.
  • Sparks Justice Court: Counterclaims and exhibit packets due 7 days before mediation. Continuance requests due 72 hours before the setting. Mediation is mandatory.
  • Henderson Justice Court: Mandatory same-day mediation at the courthouse. Unsettled cases proceed directly to trial that day.

What to Bring to Your Hearing

Arrive with organized evidence: contracts, receipts, photos, text messages, repair estimates, and anything else that supports your position. Bring at least three copies of each document — one for you, one for the judge, and one for the other party.

If you have witnesses, they need to be there in person or you'll need to subpoena them. Written statements carry less weight than live testimony.

The Cost of Not Responding

If you don't show up, the judge may enter a default judgment against you based on the plaintiff's complaint and supporting evidence, without hearing your side. That judgment is enforceable through wage garnishment, bank levies, and other collection tools. You can file a motion to set it aside, but you'll need to show a valid ground for relief and a defense — and the window is limited.

The bottom line: responding in Nevada small claims court mostly means showing up prepared. The procedure is informal, no written answer is required in most courts, and the hearing itself typically takes under an hour.
