QCAT Substituted Service: What to Do When You Can't Serve the Respondent
The general service period depends on the application: 90 days for minor debt, 28 days when another application requires personal service, or 7 days otherwise. If they've moved, they're dodging you, or they live in another state, you may need extra steps while the deadline runs.
When Substituted Service Applies
For an individual respondent in a minor-debt claim, the ordinary method is personal service — physically handing the sealed application to the respondent. Substituted service is the fallback when personal service genuinely isn't possible.
You can apply for substituted service when:
- The respondent is actively evading service (not answering the door, avoiding known locations)
- Their residential address can't be located despite reasonable searches
- Standard service methods have been attempted and failed
You cannot apply for substituted service just because personal service is inconvenient. You need to show genuine attempts first.
How to Apply: Form 42
QCAT Rule 40 allows substituted service. For a minor-debt claim, QCAT directs applicants seeking permission for substituted service or an extension of the service period to use Form 42 (Application to extend or shorten a time limit or for waiver of compliance with procedural requirement). Lodge it with the QCAT registry along with a supporting affidavit that details:
- Every attempt you've made to locate and serve the respondent (dates, times, locations, what happened)
- Searches you've conducted to find their current address (electoral roll, ASIC, social media, last known address)
- The alternative method you're proposing (email, text message, notice at last known address, Facebook message)
- Why that method will work — evidence that the proposed method is likely to bring the application to the respondent's attention
The tribunal will grant the order only if it's satisfied that personal service isn't reasonably practicable and the proposed alternative will effectively notify the respondent.
What Substituted Service Can Look Like
If the order is granted, the tribunal specifies exactly how you must serve. Common alternatives include:
- Email to an address the respondent actively uses
- Text message to a confirmed mobile number
- Posting at the respondent's last known address
- A notice left on the respondent's vehicle or workplace
- Social media message to a verified account
The order will state exactly which method or methods you must use.

Interstate Service Under SEPA
If the respondent lives outside Queensland but within Australia, first comply with the Service and Execution of Process Act 1992 (Cth), commonly called SEPA. If you still cannot serve them, ask QCAT whether an order for substituted service is needed.
Before serving interstate, attach the relevant statutory SEPA Form 1 Notice to the application. There are separate notices for general proceedings, minor civil disputes and minor debt claims; use the one that matches your case. This notice informs the respondent of their right to apply to have the matter transferred to their home state.
Failing to include the SEPA notice invalidates interstate service. If the respondent doesn't respond and you apply for a default decision, the tribunal will reject the application because service was defective.
The Interstate Jurisdiction Trap
There's a deeper issue with interstate parties. Under section 75 of the Australian Constitution, disputes between residents of different states involve federal diversity jurisdiction. QCAT includes non-judicial members, so it can only hear interstate disputes where the underlying contract or debt arose within Queensland.
If a party lives outside Queensland, check whether the underlying contract or debt arose in Queensland before filing. If it did not, QCAT may lack jurisdiction and the Magistrates Court may be the appropriate forum.
Costs and Timing
There is no prescribed fee for a Form 42 application. The tribunal must review your affidavit and approve the proposed method before you use it. For a minor-debt claim, factor that review into the 90-day service period and apply for an extension if needed.
The QCAT claim guide includes a service tracker that documents each attempt, building the evidence you need for a substituted service application if personal service fails.
