QCAT Appeal and Stay of Enforcement — Can the Debtor Block Collection?

The debtor tells you they are appealing the QCAT decision and that you cannot enforce the order until the appeal is resolved. In most cases, they are wrong.

The 28-Day Appeal Window

A party generally has 28 days to appeal, running from the statutory relevant day rather than necessarily the decision date. Some appeals are as of right; where leave is required and granted, the appeal must be filed within 21 days after leave is given. The appeal period does not prevent you from enforcing the order once the compliance deadline passes.

Appeals Do Not Automatically Stay Enforcement

This is the critical point under Section 145 of the Queensland Civil and Administrative Tribunal Act 2009: filing an appeal or an application to reopen a proceeding does not automatically stay the original decision.

The QCAT order remains enforceable unless and until QCAT, the QCAT Appeal Tribunal, or the Court of Appeal makes an explicit order staying its operation. A stay requires a separate application. The Appeal Tribunal considers the strength of the appeal, the balance of convenience, and, for a money order, whether the applicant would have difficulty recovering the amount paid if the appeal succeeds. The Court of Appeal may also stay or postpone enforcement.

What a Stay Order Means

If a stay is granted, all enforcement action pauses. You cannot register the order, apply for warrants, or proceed with financial discovery until the stay expires or is lifted.

If no stay is granted, you can proceed with enforcement in parallel with the appeal.

What Creditors Should Do

If the debtor says they are appealing:

  1. Check with the QCAT registry whether an application for leave to appeal has actually been filed.
  2. Check whether a stay order has been granted. An unfiled appeal or an appeal without a stay does not prevent enforcement.
  3. If no stay exists, proceed with registration and enforcement. You are within your rights.
  4. If a stay is granted, wait. Do not spend money on bailiff fees or warrant applications while a stay is active — the warrants cannot be executed.

After the Appeal

If the appeal is dismissed, the original QCAT order stands and enforcement continues. If the appeal succeeds and the order is varied or set aside, enforcement must stop or be adjusted to reflect the new order.
