QCAT Debt Collection Defence — When a Bank or Collection Agency Sues You

Consumer Credit Lawsuits Are a Different Category

Most QCAT minor civil disputes involve individuals or small businesses suing each other over debts, services, or goods. But if the claim against you was filed by a commercial bank, credit card issuer, buy-now-pay-later provider, debt buyer, or collection agency, you are dealing with a consumer credit matter — and the rules, protections, and free support available to you are different.

Consumer credit disputes fall under specific protective legislation, including the National Consumer Credit Protection Act 2009 (Cth) and the Australian Consumer Law. These laws give you rights that do not apply to standard person-to-person debt disputes, including hardship variation provisions, responsible lending obligations, and dispute resolution through external schemes.

Your First Call Should Be the National Debt Helpline

Before you respond to a consumer credit claim in QCAT, contact the National Debt Helpline on 1800 007 007. This is a free, confidential service staffed by qualified financial counsellors who specialise in consumer debt.

A financial counsellor can:

  • Review the claim and check whether the lender followed responsible lending obligations
  • Assess whether the debt is statute-barred (too old to enforce)
  • Help you apply for hardship variations if you cannot pay
  • Refer you to a community legal centre for legal advice specific to your situation
  • Assist with lodging complaints through the Australian Financial Complaints Authority (AFCA) if the lender or collection agency has not followed proper process

Do Not Ignore the Claim

Even though consumer credit disputes have additional protections, the QCAT procedural rules still apply. If you were served with a Form 3 minor debt application, you still have 28 calendar days to file a Form 7 response. Missing the deadline exposes you to a default decision, regardless of whether the underlying debt involves consumer credit issues.

File your response on time, and use the time between filing and the hearing to get professional advice through the National Debt Helpline or Legal Aid Queensland.

Keep QCAT Deadlines Separate From Other Complaints

Consumer credit claims are outside the scope of this guide. A complaint process with a lender or a possible AFCA complaint is separate from the QCAT response process. If you were served with a Form 3 minor debt application, the 28-day Form 7 deadline still applies while you seek help. A financial counsellor or legal service can help you identify available complaint and advice pathways.
