How to Request a QCAT Adjournment

Your QCAT hearing is scheduled but you genuinely cannot attend — a medical emergency, a pre-booked interstate commitment, or a critical witness who is unavailable on that date. You need the hearing moved, and QCAT does not grant adjournments lightly.

When QCAT Will Consider an Adjournment

The tribunal's guiding principle is that proceedings should be resolved as quickly and efficiently as possible. Adjournments delay resolution for both parties, so the bar is higher than most people expect.

Reasons that typically succeed:

  • Serious illness or injury affecting the applicant, respondent, or a key witness — supported by a medical certificate
  • Unavoidable scheduling conflict that existed before the hearing date was set, such as pre-booked travel with non-refundable tickets
  • Recent service of new evidence by the other party that you haven't had adequate time to review and respond to
  • Ongoing settlement negotiations where both parties agree that more time would likely resolve the matter without a hearing

Reasons that typically fail:

  • General unpreparedness or not having your evidence ready
  • Wanting more time to find a lawyer (QCAT is designed for self-representation)
  • Work commitments that could be rearranged with reasonable effort
  • Simply feeling nervous or unprepared

How to Apply

Adjournment requests are made using Form 40 (Application for miscellaneous matters). You state the hearing date, your QCAT file number, the reason for the request, and the period of adjournment you're seeking.

Apply as early as possible. A request lodged weeks before the hearing carries far more weight than one made the morning of. Last-minute applications require genuinely exceptional circumstances.

You must serve a copy of your adjournment application on the other party. If they consent to the adjournment, say so in your application — a joint request is far more likely to be granted than an opposed one.

Attach supporting evidence. A medical certificate, flight booking confirmation, or correspondence showing settlement progress strengthens your case considerably.

What Happens If It's Refused

If QCAT refuses your adjournment, the hearing proceeds on the scheduled date. Not attending after a refusal can result in:

  • For applicants: your application may be dismissed for non-attendance
  • For respondents: the hearing proceeds in your absence and a decision is made based on the applicant's evidence alone

If you had a reasonable excuse for missing the hearing and would suffer substantial injustice because you could not present significant new evidence, you may apply to reopen the matter using Form 43. Lodge the application within 28 days of receiving notice of the decision; a filing fee applies.

Practical Tips

Don't wait for a written ruling. If you applied close to the hearing date, phone the QCAT registry to confirm whether your adjournment has been granted before the hearing. The registry can confirm procedural status even though they cannot give legal advice.

Propose alternative dates. Rather than asking for an open-ended postponement, suggest two or three specific dates when all parties and witnesses are available. This shows good faith and makes it easier for the tribunal to reschedule.

If the other party requests an adjournment, you can consent or object. If you object, explain why — for example, if the delay would cause you financial hardship or if the other party has already been granted multiple adjournments.

Our QCAT filing guide covers hearing preparation, evidence bundles, and every procedural step — including a deadline calendar that helps you track all key dates in one place.
