PEI Small Claims Court Locations: Charlottetown and Summerside Registries

Prince Edward Island has two court registries where you can file and manage a small claim. Which one you use depends on where the dispute happened or where the defendant lives.

Charlottetown Registry

Sir Louis Henry Davies Law Courts 42 Water Street P.O. Box 2000 Charlottetown, PE C1A 7N8

  • General phone: 902-368-6000
  • Small Claims Deputy Registrar: 902-368-6003

This is the larger of the two registries and handles the majority of PEI small claims filings. The building sits in downtown Charlottetown, a short walk from the waterfront.

Summerside Registry

Summerside Law Courts 108 Central Street Summerside, PE C1N 3L4

  • Phone: 902-888-8190 / 902-888-8125

The Summerside registry serves claimants in the western part of the Island and handles filings where the dispute arose in or near Summerside.

Which Registry Do You Use?

Under Rule 74.06, you file in Charlottetown or Summerside based on:

  • Where the cause of action arose (where the contract was performed, where the damage happened, where the services were provided), or
  • Where any one defendant resides or carries on business when you start the action

If both Charlottetown and Summerside fit, either registry works. In practice, most PEI small claims go through Charlottetown because of the Island's population distribution.

Hours and Access

Both registries operate during standard business hours, Monday to Friday. They close on weekends, statutory holidays, and between Christmas and New Year. If you are working during the week, plan around those hours — there is no evening or weekend filing option.

There is no online filing portal for small claims originating documents, but the Supreme Court's Electronic Filing Practice Direction allows you to email a PDF if it is under 25 single-sided pages and does not need to be bound or tabbed. Include the completed Request to File Electronically/By Facsimile form and send the submission to [email protected]. In-person and fax filing are also available; check the direction for current filing requirements.

What to Bring

When filing your Statement of Claim (Form 7A) in person:

  • The completed Form 7A with all supporting documents attached
  • Form 8A (Designation of Address for Service)
  • Enough copies for the registry, yourself, and each defendant
  • $50 CAD filing fee (check accepted payment methods — not all registries take cards)

The registry stamps the original, retains a copy for the court file, and returns your copies for service on the defendant.

Rural Filers

If you live in Kings County, West Prince, or another rural area, the drive to Charlottetown or Summerside can be significant. Make sure your forms are complete before you go — an error means a return trip. Calling the Deputy Registrar at 902-368-6003 beforehand to confirm requirements can save time.

The PEI Small Claims Filing Guide includes a filing preparation checklist to make sure everything is ready before your trip to the registry.
