New Mexico Small Claims Filing: Paper Forms and Attorney E-Filing

Online Tools and Small Claims Filing

New Mexico has separate tools for preparing documents and electronically filing them. Guide & File is a free interview tool for selected types of filings, but the court's current list does not include small-claims civil complaints. For a small-claims case, use Form 4-201 for Magistrate Court or Form 4-202 for Metropolitan Court, then file the complaint with the court clerk in person or by mail.

eFile & Serve is New Mexico Courts' electronic civil filing system for attorneys, operated by Tyler Technologies. Civil e-filing is mandatory for attorneys. The convenience fees are $12.00 per eFile & Serve transaction, $8.00 for a File Only submission, and $0 for Serve Only. Self-represented litigants file their small-claims complaint on paper.

Which System Should You Use?

If you're representing yourself (pro se), download the correct civil complaint form and file it with the court clerk. Guide & File's current list of interviews does not include a small-claims complaint; it can generate forms for supported filing types such as an Application for Free Process. You do not pay the attorney e-filing convenience fee when filing on paper.

An attorney filing through eFile & Serve submits the complaint electronically. A self-represented filer submits the paper forms in person or by mail. For litigants in rural counties, the nearest of New Mexico's 46 Magistrate Court locations may require a long trip.

Filing a Small Claims Complaint

  1. Choose the court based on the case: Metropolitan Court for a qualifying Bernalillo County case, Magistrate Court for other counties
  2. Get Form 4-201 (Magistrate Court) or Form 4-202 (Metropolitan Court) and Form 4-204 (civil summons)
  3. Complete the complaint with the parties, claim amount, and a brief statement of facts
  4. File the complaint and summons with the court clerk in person or by mail; at Metropolitan Court, new complaints are filed at Customer Service on the first floor
  5. Pay the $77 filing fee (cash, check, or card — cards carry a 2.25% surcharge), or submit an Application for Free Process if you qualify

Guide & File also generates fee waiver applications (Application for Free Process) if you qualify based on income.

What About Filing by Email?

The Bernalillo County Metropolitan Court accepts motions and other civil pleadings by email at [email protected] and by fax at 505-222-4831. The court's filing pamphlet directs people filing a new complaint to Customer Service. This is separate from eFile & Serve — it's a Metropolitan Court-specific accommodation. Magistrate Courts in other counties generally require in-person or mail filing for pro se litigants.

Attorney E-Filing Fees at a Glance

Transaction Type Fee
Attorney eFile & Serve $12.00
Attorney File Only $8.00
Attorney Serve Only $0.00
Guide & File Free for supported filing types; current list does not include small-claims complaints

These convenience fees are on top of the standard $77 civil filing fee and apply to attorney e-filing. Self-represented filers who submit paper forms do not pay them.

When E-Filing Gets Complicated

For attorneys filing electronically, a complaint with exhibits — contracts, photos of property damage, invoices — needs PDF attachments. Each exhibit should be a separate attachment, clearly labeled. The system accepts standard document formats, but oversized files or unusual formats can cause rejection.

Service of process is a separate step entirely. Filing your complaint electronically does not serve the defendant. You still need to arrange personal service through a sheriff ($25–$50), private process server, or certified mail with return receipt — and file the Return of Service with the court after service is complete.

The Bottom Line

For most self-represented small claims filers in New Mexico, the practical route is to complete the official civil complaint forms and file them with the clerk. Guide & File is free for the filing types it supports, but its current list does not include small-claims complaints. The complete New Mexico small claims filing guide walks through each form field, service methods, and the deadlines you need to track after filing.
